International crimes and other forms of violence and the abuse of children are disturbing daily realities in today’s world. Children and young persons are increasingly and routinely targeted for the purposes of murder, rape, abduction, mutilation, recruitment as child soldiers, trafficking, sexual exploitation and other abuses. Particularly in situations of armed conflict children prove to be vulnerable and at risk. The situations in Darfur, the Democratic Republic of Congo, the Philippines, Nepal, Colombia, and many others tragically illustrate this. This book is among the very first academic publications that are solely devoted to the topic of international criminal accountability and the rights of children. A rich combination of practitioners (including ICC, ICTY and SCSL prosecutors) and academics present a wealth of relevant material in this field. They explore to what extent international law instruments and international criminal accountability mechanisms arepotentially useful for countering violations of children’s rights in and after armed conflict. Likewise, they analyze to what extent the tendency of profiling children’s rights much more strongly than before – mainly under the umbrella of the 1989 UN Convention on the Rights of the Child and in the form of child rights-based approaches – converges with the features of international criminal accountability mechanisms such as the International Criminal Court, the Yugoslavia and Rwanda Tribunals, and the Special Court for Sierra Leone. Next to academics interested in the fields of international criminal law and human rights law, practitioners, policy makers and representatives of the military will benefit from reading this book. Dr. Karin Arts is Associate Professor in International Law and Development at the Institute of Social Studies, The Hague, The Netherlands.Dr. Vesselin Popovski is Director of Studies for the International Order and Justice, Peace and Governance Programme, United Nations University, Tokyo, Japan.

How do different cultures deal with international law and how does International Law influence the rules and regulations of these cultures? Is International Law an effective tool in protecting cultural heritage, especially in wartime? Does it protect the heritage of cultures in a balanced way? And first of all: what is culture, what is International Law? These important questions were dealt with at the Fourth Conference From Peace to Justice of the Hague Academic Coalition (HAC), which was held in April 2007 in The Hague, The Netherlands. Valuable views, from different angles and perceptions, were presented and discussed. This book is the fruitful result of this Conference, presenting valuable insights, opinions and conclusions of the participants in the subject matter. It will trigger an international debate and search for clarity on these issues. Anyone interested or in any way involved in the harmonization of culture and international law is invited to join the debate, thus contributing to the realization of another important step on the road from peace to security.Paul Meerts is an advisor to the Director of the Netherlands Institute of International Relations ‘Clingendael’ in The Hague and Professor in Diplomatic Negotiation.

What does ‘constitutionalism’ mean in our age of globalisation? In which contexts does the discourse of constitutionalism occur? What factors contribute to the creation of a ‘culture’ of constitutionalism at the nation-state level? And can one talk about constitutionalism beyond the state, for example at the European and international levels? These are some of the questions that formed the basis for discussion at the Fifth ‘From Peace to Justice’ Conference of the Hague Academic Coalition in May 2008. With the concepts of power and governance becoming more diverse and multi-faceted, the conference considered constitutionalism at the national, European and international levels, exploring from a variety of viewpoints the changing meaning of constitutionalism in today’s globalised world.Specific to this book:•Each chapter includes a summary of its content, giving the reader an overview of the subject matter and the questions being discussed•The summaries are translated into French, making it more accessible to French speakers•Includes an extended bibliography focusing on constitutionalism; prepared by the Peace Palace Library, it provides interested readers with a useful source for further research
