Human rights and the courts and tribunals that protect them are increasingly part of our moral, legal, and political circumstances. The growing salience of human rights has recently brought the question of their philosophical foundation to the foreground. Theorists of human rights often assume that their ideal can be traced to the philosophy of Immanuel Kant and his view of humans as ends in themselves. Yet, few have attempted to explore exactly how human rights should be understood in a Kantian framework. The scholars in this book have gathered to fill this gap. At the center of Kant’s theory of rights is a view of freedom as independence from domination. The chapters explore the significance of this theory for the nature of human rights, their justification, and the legitimacy of international human rights courts.

'Subsidiarity' is vague and contested, yet popular in scholarship about international law due to its role in the European Union (EU). Which conceptions of subsidiarity are more justifiable, and how might they contribute to international law? A principle of subsidiarity concerns how to establish, allocate, or use authority within a social or legal order, stating a rebuttable presumption for the local. Various historical patterns, practices, principles, and justifications offer different recommendations. Seven normative theories vary in how immunity protecting or person promoting they are. The latter appear more justifiable and withstand criticism often raised against subsidiarity. Some conceptions of person promoting subsidiarity serve as a structuring principle for international law and fullfills several criteria of a general principle of law. It can harmonize domestic and international law but is not sufficient to reduce fragmentation among sectors with different objectives.

The present volume in a series of books produced from European Business Eth ics Network (EBEN) conferences in Europe, is a compilation of plenary speeches and papers presented at the 1993 EBEN conference in Oslo, Norway. The theme of this year''s conference was "The Use of Consultancy: Ethical Demands and Require ments" and there was a special focus on Eastern Europe. Of over 40 papers present ed at the conference from 165 participants representing 23 countries, we present here 20 selected by the editors as providing an overview of the latest thinking from both academicians and practitioners on the subject of ethics in consulting. Due to strict constraints on space in this volume, several valuable papers presented at the conference must be published elsewhere. We have also tried to maintain the unique flavor of the papers by authors whose mother tongue is not English. The consulting profession is booming in Europe, both in the West and in the for mer Communist Bloc countries. However, it has not previously been subjected to rigorous scrutiny from the ethical point of view. The conference planning commit tee thus sought to put the spotlight on the spreading phenomenon of buying and selling consultancy services within the European Union, within Europe and with the new Eastern Europe. The conference addressed several ethical challenges facing either the buyers or providers of consultancy services in both the private and public sectors.
