This book examines the effects of digitalisation on consumers and markets, and whether consumer law rules are fit for purpose.Examining existing consumer law as it interconnects with the related spheres of competition law, intellectual property law, human rights law and dispute resolution regimes, it considers the future of rule and regime building for consumer protection in the face of digital disruption. Offering new perspectives on recent legal developments for consumers, this book examines how general consumer protection principles deal with emergent issues such as the regulation of cryptocurrencies, online auctions, artificial intelligence, intellectual property and digital content services. It highlights issues of cross-border choice of law and enforcement issues for consumer protection as it relates to digital disruption. Exploring the consumer law and policy of the EU and closely related jurisdictions, this volume offers insights that could help inform debates and build rules and regimes for consumer protection. The book will be of interest to postgraduate students, academics and policymakers, given the worldwide challenges presented by digital disruption to consumer protection.

This thoroughly revised and updated Research Handbook addresses key questions and challenges in EU private international law. Bringing together perspectives from both civil and common law, it examines not only civil matters, such as contract and tort, but also recent developments in family and succession law.Expanding on topics discussed in the first edition, this Handbook includes new chapters on class actions, party autonomy, behavioural economics and the harmonisation of private international law in successions and parental responsibility. It adds to the analysis of the Rome I and II Regulations, with particular focus on the law applicable to defamation and privacy. The Handbook also explores parallel proceedings and the lis pendens rules, as well as a novel application of the effectiveness of EU law in the context of both Brussels I and arbitration. This edition assesses current proceedings and identifies new areas for improvement in EU private international law. This illuminating Handbook is a crucial reference point for scholars and students in private international law, European law, family law and the law of succession. Legal practitioners and commercial lobbyists will also benefit from its insights.

Families in Europe are increasingly shaped by the mobility of persons and multicultural backgrounds. This book is focusing on the protection of children in cross-border situations. What are the fundamental rights of children in transnational families, what is in their ‘best interest’, and how can their rights be safeguarded? There is much controversy on these rights and the accompanying uncertainty has resulted in considerable practical difficulties for those trying to implement them.In order to provide a clearer scope and insights into the nature of children’s fundamental rights and their best interests, this book examines solutions provided by both EU and international law to the questions raised by the increasing incidence of transnational families as regards the protection of minors. It covers both substantive and conflict-of-laws rules. Differences in the substantive family laws of Member States still prevent an effective protection of the child or its family unit. This includes cases of migration, asylum, forced marriage, kafalah, but also rainbow families. Further, the role of human rights (mutual recognition of status and surrogacy agreements, adoption) and procedural rights (child abduction, Brussels II bis recast) in cross-border cases must be considered carefully.Fundamental Rights and the Best Interest of the Child in Transnational Families is a timely work on the implementation of the child’s interests in the EU and covers the most relevant topics emerging from the rapid internationalisation of child and family law and from the increased mobility of families.
