The distinction between male and female, or masculinity and femininity, has long been considered to be foundational to society and the organization of its institutions. In the last decades, the massive literature on gender has challenged this discursive construction. Gender has been disassembled and reassembled, variously considered as social practice, performance, ideology. Yet the binary relationship ‘man/woman’ continues to be a characteristic trait of Western societies. This book gathers together contributions by experts in various fields – including law, sociology, philosophy and anthropology – to pin down the relationship between institutions and the gender binary. Centrally, it examines the way in which the present-day gender binary is shored up by the conceptualization and regulation of sex and gender at societal and institutional levels. Based on this examination, it tackles the issue of what the practices and processes of subjectivation are that preserve this binary distinction as the foundation of gender. Each of the chapters discusses this pressing question with a view to considering whether current equality policies challenge hierarchical and hegemonic understandings of gender or are the residue of a sexist understanding of gender. This analysis then paves the way for a more general and crucial question: whether institutions can, or should, contribute to the process of deconstructing the gender binary.

This book revisits the embrace of liberal capitalism in post-communist Eastern Europe to show that recent concerns about the rise of populist movements obfuscate the limits and the contradictions inherent in the concept. The imposition of the liberal framework’s economic policies, institutional designs, and ideology across an entire region provides a unique opportunity to show the effects of the European project. Chapter contributors explore how the problems of the framework are most visibly demonstrated in post-communist countries, where the internal tensions of liberal capitalism clash with locally embedded values. Recent research has focused on developments in the region in terms of how much the respective countries have strayed from liberal standards. This book replaces this discourse with a more profound and fresh interpretation of regional developments by exposing some of the underlying dominant ideas as ill-equipped to grasp the complexity of the current predicament. Bridging economy, politics, and culture this interdisciplinary study will be of particular interest to scholars and students of political philosophy, European law, international relations, political economy, cultural studies, history, memory, and identity.

This book analyses human rights in post-national contexts and demonstrates, through the case law of the European Court of Human Rights, that the Margin of Appreciation doctrine is an essential part of human rights adjudication.Current approaches have tended to stress the instrumental value of the Margin of Appreciation, or to give it a complementary role within the principle of proportionality, while others have been wholly critical of it. In contradiction to these approaches this volume shows that the doctrine is a genuinely normative principle capable of balancing conflicting values. It explores to what extent the tension between human rights and politics, embodied in the doctrine, might be understood as a mutually reinforcing interplay of variables rather than an entrenched separation. By linking the interpretation of the Margin of Appreciation doctrine to a broader conception of human rights, understood as complex political and moral norms, this volume argues that the doctrine can assist in the formulation of the common good in light of the requirements of the Convention.
