An open access title available under the terms of a CC BY-NC-ND 4.0 International licenceAntarctica is the coldest, windiest, driest, and highest continent in the world, so it is no wonder that it has been painted as exceptional in geographic and climatic terms. But not only that: Antarctica is also seen as exceptional politically. Since the Antarctic Treaty came into force in 1961, it has been under the Joint Guardianship of a group of states that have kept peace and privileged science as the main activity on the continent, with a focus on the protection rather than the exploitation of nature.For natural scientists, Antarctica is seen as the largest open-air laboratory in the world. In From Sovereignty to Guardianship, Alejandra Mancilla proposes that Antarctica should also be seen as a laboratory for territorial governance, providing inspiration in places where both the regime of Permanent Sovereignty over Natural Resources of individual states and the international regime of Common Heritage of Mankind have proven insufficient and inadequate. At the same time, she shows that Antarctic governance has important limits that can be surmounted to be made less state-centric and less anthropocentric, embracing the fact that protecting Antarctica requires acting beyond Antarctica, and vice versa. Given the global environmental challenges that we face, and the growing challenges to international law and cooperation, this book argues that environmental governance around the world can--and should--benefit from the creative and often unexpectedly fruitful political imagination of Antarctica.

Forty years ago, in his landmark work A Theory of Justice, the American philosopher John Rawls depicted a just society as a fair system of cooperation between citizens, regarded as free and equal persons. Justice, Rawls famously claimed, is 'the first virtue of social institutions'. Ever since then, moral and political philosophers have expanded, expounded and criticized Rawls's main tenets, from perspectives as diverse as egalitarianism, left and right libertarianism and the ethics of care. This volume of essays provides a general overview of the main strands in contemporary justice theorising and features the most important and influential theories of justice from the 'post Rawlsian' era. These theories range from how to build a theory of justice and how to delineate its proper scope to the relationship between justice and equality, justice and liberty, and justice and desert. Also included is the critique of the Rawlsian paradigm, especially from feminist perspectives and from the growing strand of 'non-ideal' theory, as well as consideration of more recent developments and methodological issues.

This book explores how the concept of colonialism can help to understand the past and present of Antarctica, and how Antarctica may illuminate the limits of colonialism as an analytic concept. Despite lacking an indigenous population, the continent has been shaped by many of the same political and economic forces that have defined the rest of the world – notwithstanding its unique governance arrangement, the Antarctic Treaty System. The book provides a fresh and timely set of contributions that critically explore different practices, attitudes and logics that suggest that colonialism may have been and may still be present in Antarctica, ranging from religion to material culture to the treatment of animals. The chapters also explore the connection between colonialism and cognate terms like capitalism, socialism, nationalism, and environmentalism.An electronic edition of this book is freely available under a Creative Commons (CC BY-NC-ND) licence.

Does recognition of the basic human right to subsistence imply that the needy are morally permitted to take and use other people’s property to get out of their plight? Should we respect the exercise of this right of necessity in a variety of scenarios – from street pickpocketing and petty theft to illegal squatting and encamping? In this concise and accessible book, Alejandra Mancilla addresses these complex and controversial moral questions. The book presents a historical account of the concept of the right of necessity—from the medieval writings of Christian canonists and theologians to seventeenth century natural law theory. The author then goes on to ground this right in a minimal conception of basic human rights, and proposes some necessary and jointly sufficient conditions for its exercise. She confronts the main objections that may be posed against this principle and ultimately concludes that the exercise of this right should be considered as a trigger to secure a minimum threshold of welfare provisions for everyone, everywhere.
