The search for a robust balance of power is a continuous challenge for multilevel political system. Institutions like parliaments or courts can protect the existing order. However, necessary adjustments to economic, social, or international challenges or policies determined to improve ineffective structures or to prevent disintegration require constitutional amendments. Whereas constitutional policy appears as essential to maintain balance, changing a constitution is rather difficult in multilevel governments. Due to the veto power of many actors pursuing divergent interests, policies aiming to redistribute power or fiscal resources risk to end in the joint decision trap. Hence, multilevel government is confronted by a fundamental dilemma.Constitutional Policy in Multilevel Government compares processes of constitutional reform in federal and regionalized states. Based on a theoretical framework emphasizing the relevance of negotiations in parliamentary, intergovernmental, and societal arenas, it identifies conditions for successful reforms and explains the consequences of failed reforms. Moreover, it highlights the interplay of reform processes and constitutional evolution as essential to maintaining a robust balance of power. Federal systems are praised for creating political stability, but they are also blamed for causing rigidity. Federal Dynamics: Continuity, Change and Varieties of Federalism investigates mechanisms and resulting patterns of federal development. 1 Einleitung Gegenstand des vorliegenden Textes ist das Regieren in komplexen Mehre- nensystemen (multilevel governance). Mit der Einführung dieses Begriffs bricht die Politikwissenschaft mit einer lange verbreiteten Prämisse, wonach Herrschaft in der modernen Gesellschaft überwiegend in autonomen und hierarchisch - gliederten Organisationen des Regierens ausgeübt wird. Wenngleich sich dieser Perspektivenwandel lange abzeichnete und eher schleichend vollzog, kommt er erst neuerdings in Konzepten des Politischen deutlich zum Ausdruck. Multilevel governance ist eines dieser Konzepte. Einheit und Differen- Die Vorstellung, Gesellschaften würden in hierarchisch geordneten Einh- zierung im modernen ten gesteuert, hat lange Zeit nicht nur das Denken über Wirtschaftsbetriebe, Ver- Staat bände und Verwaltungen beeinflusst, die als Unternehmen oder Bürokratie - trachtet wurden, sie prägte vor allem auch die Beschreibung politischer Systeme als Staaten. Der Begriff des modernen Staates erfasst eine Vereinigung von Menschen zu einer Staatsbürgernation, die durch Selbstbestimmung die He- schaft in einem nach außen abgegrenzten Gebiet organisiert (Benz 2008: 105- 168). Dabei wurde vielfach unterstellt, der Staat konstituiere eine Einheit von Staatsgebiet, Staatsvolk und souveräner Staatsgewalt. Diese Annahme ist jedoch nicht nur theoretisch unangemessen, weil zu abstrakt, sie ignoriert auch unt- schiedliche Formen der politischen Herrschaft, die im Laufe der Geschichte entstanden. Die genannte Definition berücksichtigt nicht, dass die interne Str- tur eines konkreten Staates in territorialer und funktionaler Hinsicht differenziert ist.

Regionalisierung und Dezentralisierung gelten als Strategien staatlicher Modemisierung. Sie verweisen beide auf einen Prozeß der Veränderung politischer Strukturen. Während jedoch Dezentralisierung die Verlage rung von Aufgaben zwischen Gebietskörperschaften im Zusammenhang mit der Differenzierung der territorialen Organisationsstrukturen bedeu tet, beinhaltet Regionalisierung die Entwicklung einer neuartigen Form von Politik, für die der Raum als Kontext zur Erfüllung öffentlicher Auf gaben relevant wird. Dieser Raum konstituiert sich in Prozessen der Ko operation von Akteuren und Organisationen, die ihre Handlungen und Ressourcen mit dem Ziel einer gemeinsamen Förderung und Gestaltung regionaler Entwicklungen bündeln. Regionalisierung führt zu neuen Poli tikinhalten, und zwar im Hinblick auf Problemdefinition und Politikziele, aber auch zu neuen Handlungsformen. Sie erzeugt neue Strukturen und Verfahrensmodi, indem die Region zu einem neuen Forum der Mobilisie rung von Kooperation, Beteiligung und demokratischer Selbstbestimmung wird. Diese bringen neue Akteure ins Spiel und verändern Akteurskonstel lationen. Region stellt somit einen Raum dar, der im Sinne eines sozialen Kontextes zu verstehen ist und dessen Ausdehnung nur mit Bezug auf seine Funktionen und deshalb immer wieder neu zu bestimmbl ist. Mit dieser Definition von Regionalisierung gren~en wir uns von ei nem ausschließlich institutionellen Verständnis von Region ab, wie es in den Rechts- bzw. Verwaltungswissenschaften immer noch verbreitet und auch im europapolitischen Diskurs oft gebräuchlich ist, wenn von einem "Europa der Regionen" gesprochen wird. Rechts- und Verwaltungswissenschaften befassen sich in erster Linie mit der Normierung und Institutionalisierung von kollektivempolitischen Handeln.
