Politics of Religious Freedom

In a remarkably short period of time, religious freedom has achieved broad consensus as an indispensable condition for peace. Faced with widespread reports of religious persecution, public and private actors around the world have responded with laws and policies designed to promote freedom of religion. But what precisely is being promoted? What are the cultural and epistemological assumptions underlying this response, and what forms of politics are enabled in the process? The fruits of the three-year Politics of Religious Freedom research project, the contributions to this volume unsettle the assumption - ubiquitous in policy circles - that religious freedom is a singular achievement, an easily understood state of affairs, and that the problem lies in its incomplete accomplishment. Taking a global perspective, the contributors delineate the different conceptions of religious freedom predominant in the world today, as well as their histories and social and political contexts.Together, the contributions make clear that the reasons for persecution are more varied and complex than is widely acknowledged, and that the indiscriminate promotion of a single legal and cultural tool meant to address conflict across a wide variety of cultures can have the perverse effect of exacerbating the problems that plague the communities cited as falling short.

In a remarkably short period of time, the realization of religious freedom has achieved broad consensus as an indispensable condition for peace. Faced with widespread reports of religious persecution, public and private actors around the world have responded with laws and policies designed to promote freedom of religion. But what precisely is being promoted? What are the cultural and epistemological assumptions underlying this response, and what forms of politics are enabled in the process? The fruits of the three-year Politics of Religious Freedom research project, the contributions to this volume unsettle the assumption—ubiquitous in policy circles—that religious freedom is a singular achievement, an easily understood state of affairs, and that the problem lies in its incomplete accomplishment. Taking a global perspective, the more than two dozen contributors delineate the different conceptions of religious freedom predominant in the world today, as well as their histories and social and political contexts. Together, the contributions make clear that the reasons for persecution are more varied and complex than is widely acknowledged, and that the indiscriminate promotion of a single legal and cultural tool meant to address conflict across a wide variety of cultures can have the perverse effect of exacerbating the problems that plague the communities cited as falling short.

Ekklesia: Three Inquiries in Church and State offers a New World rejoinder to the largely Europe-centered academic discourse on church and state. In contrast to what is often assumed, in the Americas the relationship between church and state has not been one of freedom or separation but one of unstable and adaptable collusion. Ekklesia sees in the settler states of North and South America alternative patterns of conjoined religious and political power, patterns resulting from the undertow of other gods, other peoples, and other claims to sovereignty. These local challenges have led to a continuously contested attempt to realize a church-minded state, a state-minded church, and the systems that develop in their concert. The shifting borders of their separation and the episodic conjoining of church and state took new forms in both theory and practice. The first of a closely linked trio of essays is by Paul Johnson, and offers a new interpretation of the Brazilian community gathered at Canudos and its massacre in 1896-97, carried out as a joint church-state mission and spectacle. In the second essay, Pamela Klassen argues that the colonial church-state relationship of Canada came into being through local and national practices that emerged as Indigenous nations responded to and resisted becoming "possessions" of colonial British America. Finally, Winnifred Sullivan's essay begins with reflection on the increased effort within the United States to ban Bibles and scriptural references from death penalty courtrooms and jury rooms; she follows with a consideration of the political theological pressure thereby placed on the jury that decides between life and death. Through these three inquiries, Ekklesia takes up the familiar topos of "church and state" in order to render it strange.

Ministry of Presence
Chaplaincy, Spiritual Care, and the Law

Most people in the United States today no longer live their lives under the guidance of local institutionalized religious leadership, such as rabbis, ministers, and priests; rather, liberals and conservatives alike have taken charge of their own religious or spiritual practices. This shift, along with other social and cultural changes, has opened up a perhaps surprising space for chaplains--spiritual professionals who usually work with the endorsement of a religious community but do that work away from its immediate hierarchy, ministering in a secular institution, such as a prison, the military, or an airport, to an ever-changing group of clients of widely varying faiths and beliefs. In A Ministry of Presence, Winnifred Fallers Sullivan explores how chaplaincy works in the United States--and in particular how it sits uneasily at the intersection of law and religion, spiritual care, and government regulation. Responsible for ministering to the wandering souls of the globalized economy, the chaplain works with a clientele often unmarked by a specific religious identity, and does so on behalf of a secular institution, like a hospital. Sullivan's examination of the sometimes heroic but often deeply ambiguous work yields fascinating insights into contemporary spiritual life, the politics of religious freedom, and the never-ending negotiation of religion's place in American institutional life.

An absorbing collection of essays on religious textures in Knausgaard’s writings and our time.Min kamp, or My Struggle, is a six-volume novel by Karl Ove Knausgaard and one of the most significant literary works of the young twenty-first century. Published in Norwegian between 2009 and 2011, the novel presents an absorbing first-person narrative of the life of a writer with the same name as the author, in a world at once fully disillusioned and thoroughly enchanted. In 2015, a group of scholars began meeting to discuss the peculiarly religious qualities of My Struggle. Some were interested in Knausgaard’s attention to explicitly religious subjects and artworks, others to what they saw as more diffuse attention to the religiousness of contemporary life. The group wondered what reading these textures of religion in these volumes might say about our times, about writing, and about themselves. The Abyss or Life Is Simple is the culmination of this collective endeavor—a collection of interlocking essays on ritual, beauty, and the end of the world.

From right to left, notions of religion and religious freedom are fundamental to how many Americans have understood their country and themselves. Ideas of religion, politics, and the interplay between them are no less crucial to how the United States has engaged with the world beyond its borders. Yet scholarship on American religion tends to bracket the domestic and foreign, despite the fact that assumptions about the differences between ourselves and others deeply shape American religious categories and identities. At Home and Abroad bridges the divide in the study of American religion, law, and politics between domestic and international, bringing together diverse and distinguished authors from religious studies, law, American studies, sociology, history, and political science to explore interrelations across conceptual and political boundaries. They bring into sharp focus the ideas, people, and institutions that provide links between domestic and foreign religious politics and policies. Contributors break down the categories of domestic and foreign and inquire into how these taxonomies are related to other axes of discrimination, asking questions such as: What and who counts as “home” or “abroad,” how and by whom are these determinations made, and with what consequences?Offering a new approach to theorizing the politics of religion in the context of the American nation-state, At Home and Abroad also interrogates American religious exceptionalism and illuminates imperial dynamics beyond the United States.

There is an enduring fascination with Joan of Arc, yet she is almost always seen alone, as a victim or martyr. A strikingly different person is heard in her letters and the testimony of her companions. To the king of England, she wrote, “I am a commander of war, and in whatever place I come upon your men in France, I will make them leave . . . And if they do not wish to obey, I will have them all killed.” She wrote to the people of the towns she defended, giving them news and seeking their support. Her companions spoke of her intelligence, bravery, and military competence. Hers was a collective mission to rescue the people from the depredations of war.Focusing on her life rather than her death, Winnifred Fallers Sullivan offers an interpretation of Joan of Arc as a political thinker and actor who sought, during her meteoric presence in fifteenth-century France, to legitimate a king, channel God’s word, convene a coronation, and speak for the people in an alternative legal order. She assembled sacred kingship, mystical experience, and the press of political and economic chaos into a vernacular political theology that still speaks to our moment. Making a King illuminates Joan’s extraordinary life and vision—her conception of sovereignty from below, her form of female masculinity, and her power as kingmaker—and shows why she can help us find a deeper understanding of religion and politics today.

How does viewing the American project through a theological lens complicate and enrich our understanding of America? Theologies of American Exceptionalism is a collection of fifteen interlocking essays reflecting on exceptionalist claims in and about the United States. Loosely and generatively curious, these essays bring together a range of historical and contemporary voices, some familiar and some less so, to stimulate new thought about America. Thinking theologically allows authors to revisit familiar themes and events with a new perspective; old and new wounds, enduring narratives, and the sacrificial violence at the heart of America are examined while avoiding both the triumphalism of the exceptional and the temptations of the jeremiad. Thinking theologically also involves thinking, as Joseph Winters recommends, with the "unmourned." It allows for an understanding of America as fundamentally religious in a very specific way. Together these essays challenge the reader to think America anew.

More than the citizens of most countries, Americans are either religious or in jail--or both. But what does it mean when imprisonment and evangelization actually go hand in hand, or at least appear to? What do "faith-based" prison programs mean for the constitutional separation of church and state, particularly when prisoners who participate get special privileges? In Prison Religion, law and religion scholar Winnifred Fallers Sullivan takes up these and other important questions through a close examination of a 2005 lawsuit challenging the constitutionality of a faith-based residential rehabilitation program in an Iowa state prison. Americans United for the Separation of Church and State v. Prison Fellowship Ministries, a trial in which Sullivan served as an expert witness, centered on the constitutionality of allowing religious organizations to operate programs in state-run facilities. Using the trial as a case study, Sullivan argues that separation of church and state is no longer possible. Religious authority has shifted from institutions to individuals, making it difficult to define religion, let alone disentangle it from the state.Prison Religion casts new light on church-state law, the debate over government-funded faith-based programs, and the predicament of prisoners who have precious little choice about what kind of rehabilitation they receive, if they are offered any at all.

The Constitution may guarantee it. But religious freedom in America is, in fact, impossible. So argues this timely and iconoclastic work by law and religion scholar Winnifred Sullivan. Sullivan uses as the backdrop for the book the trial of Warner vs. Boca Raton, a recent case concerning the laws that protect the free exercise of religion in America. The trial, for which the author served as an expert witness, concerned regulations banning certain memorials from a multiconfessional nondenominational cemetery in Boca Raton, Florida. The book portrays the unsuccessful struggle of Catholic, Protestant, and Jewish families in Boca Raton to preserve the practice of placing such religious artifacts as crosses and stars of David on the graves of the city-owned burial ground.Sullivan demonstrates how, during the course of the proceeding, citizens from all walks of life and religious backgrounds were harassed to define just what their religion is. She argues that their plight points up a shocking truth: religion cannot be coherently defined for the purposes of American law, because everyone has different definitions of what religion is. Indeed, while religious freedom as a political idea was arguably once a force for tolerance, it has now become a force for intolerance, she maintains.A clear-eyed look at the laws created to protect religious freedom, this vigorously argued book offers a new take on a right deemed by many to be necessary for a free democratic society. It will have broad appeal not only for religion scholars, but also for anyone interested in law and the Constitution.Featuring a new preface by the author, The Impossibility of Religious Freedom offers a new take on a right deemed by many to be necessary for a free democratic society.

Many today place great hope in law as a vehicle for the transformation of society and accept that law is autonomous, universal, and above all, secular. Yet recent scholarship has called into question the simplistic narrative of a separation between law and religion and blurred the boundaries between these two categories, enabling new accounts of their relation that do not necessarily either collapse them together or return law to a religious foundation. This work gives special attention to the secularism of law, exploring how law became secular, the phenomenology of the legal secular, and the challenges that lingering religious formations and other aspects of globalization pose for modern law's self-understanding. Bringing together scholars with a variety of perspectives and orientations, it provides a deeper understanding of the interconnections between law and religion and the unexpected histories and anthropologies of legal secularism in a globalizing modernity.

Advocacy for religious freedom has become a global project while religion, and the management of religion, has become of increasing interest to scholars across a wider range of disciplines. Rather than adopting the common assumption that religious freedom is simply incompletely realized, the authors in this book suggest that the starting point for understanding religion in public life today should be religious establishment. In the hyper-globalized world of the politics of religious freedom today, a focus on establishments brings into view the cultural assumptions, cosmologies, anthropologies, and institutions which structure religion and religious diversity. Leading international scholars from a diverse range of disciplines explore how countries today live with religious difference and consider how considering establishments reveals the limitations of universal, multicultural, and interfaith models of religious freedom. Examining the various forms religion takes in Tunisia, Canada, Taiwan, South Africa, and the USA, amongst others, this book argues that legal protections for religious freedom can only be understood in a context of socially and culturally specific constraints.
