Eagle Down Is Our Law is about the struggle of the Witsuwit'en peoples to establish the meaning of aboriginal rights. With the neighbouring Gitksan, the Witsuwit'en launched a major land claims court case asking for the ownership and jurisdiction of 55,000 square kilometers of land in north-central British Columbia that they claim to have held since before the arrival of the Europeans. In conjunction with that court case, the Gitksan and Witsuwit'en asked a number of expert witnesses, among them Antonia Mills, an anthropologist, to prepare reports on their behalf. Her report, which instructs the judge in the case on the laws, feasts, and institutions of the Witsuwit'en, is presented here. Her testimony is based on two years of participant observation with the Witsuwit'en peoples and on her reading of the anthropological, historic, archaeological, and linguistic data about the Witsuwit'en.In 1991, the judge who rendered the decision in the court case, known as Delgamuukw v. the Queen, dismissed the testimony of Mills and other anthropologists and ruled that the Witsuwit'en and Gitksan have no aboriginal title.This book contains the report that Mills rendered to the court. With its publication, the public can judge the quality of the expert opinion report for themselves. The report is introduced by Chief Gisdaywa (Alfred Joseph) of the Witsuwit'en, Chief Mas Gak (Don Ryan) of the Gitksan, anthropologist Michael Kew, and legal scholar Michael Jackson. Until now few people have been aware of the prevalence of belief in some form of rebirth or reincarnation among North American native peoples. This collection of essays by anthropologists and one psychiatrist examines this concept among native American societies, from near the time of contact until the present day.Amerindian Rebirth opens with a foreword by Gananath Obeyesekere that contrasts North American and Hindu/Buddhist/Jain beliefs. The introduction gives an overview, and the first chapter summarizes the context, distribution, and variety of recorded belief. All the papers chronicle some aspect of rebirth belief in a number of different cultures. Essays cover such topics as seventeenth-century Huron eschatology, Winnebago ideology, varying forms of Inuit belief, and concepts of rebirth found among subarctic natives and Northwest Coast peoples.The closing chapters address the genesis and anthropological study of Amerindian reincarnation. In addition, the possibility of evidence for the actuality of rebirth is addressed. In 1985 and 1986, ninety-year-old Witsuwit'en Chief, Maxlaxlex – or Johnny David as he is better known – was the first Witsuwit'en to give Commission Evidence in the Delgamuukw land claims case in which the Witsuwit'en and Gitxsan of Northern British Columbia were battling for title to their traditional territories. 'Hang Onto These Words' presents the actual transcripts of the questions and answers between lawyers working on both sides and this knowledgeable and outspoken Native elder who spoke in his own language and whose words were then translated by an interpreter into English. The evidence was given in a makeshift courtroom set up in David's own home. Anthropologist Antonia Mills was present during these proceedings, and in this book, she introduces and contextualizes the evidence within the Delgamuukw case. In his testimony, David provides a rich description of the Witsuwit'en way of life as well as the injustices suffered at the hands of Indian agents and settlers. He ends his testimony saying, "If you hang on to these words, everything will be all right." The challenge of hearing his voice, and using it to negotiate the meaning and substance of Aboriginal rights remains unresolved and resonant.
