A critical overview of European Union energy law and policy, this book takes a law-in-context approach as it examines the development of EU energy law from the 1950s to the present day. It discusses the development of EU energy law; the application of general EU law into energy; the regulation of EU energy markets; international aspects of EU energy law; and policy, sustainability, and energy regulation. Presenting an up-to-date overview of EU energy law and policy and a critical analysis of its sub-areas, the book extends the discussion from electricity and natural gas markets to other areas of energy, including oil. This holistic approach to the subject is then placed within the broader context of the international geopolitical sphere which EU energy law and policy operates, as the author considers the impact of regional and international energy policies and markets on the EU markets and the overall EU policy. He also draws on the wider context and takes into account non-legal factors such as the impact of unconventionals, the rise of the BRICS, and the 'Arab spring'. The book frames EU energy law as a topic that can provoke intellectual, political, and professional discussion about the slowly moving train of economic regulation under the typical pressures and contradictions of countries and the European Union in the global economy.

Hydrogen is increasingly seen as a key element of Europe’s energy transition, central to both decarbonisation and energy security. This edited volume provides a comprehensive and systematic analysis of what can be called “Hydrogen Law” in the European Union and Europe, examining how law and governance are shaping the emergence of a hydrogen market. The volume brings together leading academic and practitioner perspectives to analyse the evolving regulatory framework for hydrogen across the entire value chain, from production and certification to infrastructure, markets, public funding, and international trade. It situates hydrogen within EU energy and climate law, explores key concepts such as renewable and low-carbon hydrogen, and addresses cross-cutting issues including state aid, network regulation, planning, public participation, and justice. Combining general legal analysis with regional and comparative case studies – such as hydrogen valleys, hubs, and partnerships with third countries – the volume highlights regulatory challenges, emerging solutions, and future pathways towards a coherent European hydrogen law.The book is aimed at scholars, policymakers, regulators, legal practitioners, and advanced students working in energy law, EU law, sustainability, and the energy transition, as well as stakeholders involved in hydrogen markets and infrastructure development.

This timely collection of essays examines the legal and regulatory dynamics of energy transitions in the context of emerging trends towards decarbonisation and low-carbon energy solutions. The book explores this topic by considering the applicable energy law and policy frameworks in both:(i) highly industrialised and major economies such as the US, EU, China and Australia;(ii) resource-rich developing countries such as Nigeria and regions like Southern Africa.Comprising 16 chapters, the book delves into the tradeoffs and regulatory complexities of carbon-constraints in conventional energy supply systems, while maintaining a reliable and secure energy system that is equally sustainable (ie decarbonised). It highlights the importance of ensuring affordable access to energy services in developing economies as the energy transitions unfold and explores the potentials of emerging technologies such as hydrogen networks, power-to-gas and Carbon Capture and Storage. Additionally, the book also considers the international investment law implications of energy decarbonisation.Focusing on the nexus between law, regulation and institutions, it adopts a contextual approach to examine how and to what extent institutions can effectively facilitate more reliable, sustainable and secure energy supply systems in the twenty-first century. This book portrays the conventional hydrocarbon-based energy supply industry in a largely international and interconnected context. It highlights the costs, benefits and losses that may arise as the transition towards decarbonisation unfolds depending on the pathways and solutions adopted. With chapters written by leading experts in energy law and policy, the reader-friendly style and engaging discussions will benefit an international audience of policymakers, academics, students and advisers looking for a more incisive understanding of the issues involved in energy transitions and the decarbonisation of energy systems.

This third volume of EU Energy Law and Policy Issues presents an overview of some of the most recent developments taking place in the EU energy sector at a time when the Third Energy Package is likely to be or has been implemented in the EU Member States. In this respect, the reader will find a number of contributions which offer detailed and critical views on some of the main issues tackled by the Third Energy Package. Aside from this, the relationship between sector specific regulation and the rules of general competition law is examined in the second section of the book. This part also contains particular contributions on access regimes in gas and electricity markets as well as an innovating analysis on the methods for allocating allowances under the EU Emissions trading scheme and the interaction of such methods with EU state aid rules. Just like the previous volumes of the book, section III offers a deep insight into the external aspects of EU energy policy. Accordingly, the role of the Lisbon Treaty in promoting EU energy policy in the international arena is scrutinized in addition to the most recent evolutions on the topical issue of the Energy Charter Treaty. This section is completed with a daring contribution about the need to adopt a comprehensive theory of legal harmonization between the EU and third partners, which is presented using the specific case of the EU-Russia Energy Dialogue. Last but not least, some fundamental issues regarding the environmental aspects of EU Energy policy undergo an in-depth study in the final section of the book. Not only is the legal regime of energy efficiency in energy-related products examined, but also the issue of carbon constraining policies under WTO law. Finally, the electricity's industry viewpoint on the 2020 targets rounds off this third volume of EU Energy Law and Policy Issues with judicious comments. This book will surely prove to be an essential piece of reading for lawyers, legal advisers, academics or students engaged in the field of energy law. With contributions by Nicole Ahner, Daniel Behn, Andrei Belyi, Henrik Bjornebye, Jakub Handrlica, Adrien de Hauteclocque, Thomas Deruytter, Wouter Geldhof, Silke Goldberg, Michael Hunt, Britta Lewendel, Tom Maes, Kathleen Mertens, Cecile Musialski, Christian Pielow, Nicola Rega, Tatiana Romanova, Kim Talus, Caroline Van den bergh and Frederik Vandendriessche.

International energy law is an elusive but important concept. There is no body of law called 'international energy law', nor is there any universally accepted definition for it, yet many specialized areas of international law have a direct relationship with energy policy. The Research Handbook on International Energy Law examines various aspects of international energy law and offers a comprehensive account of its basic concepts and processes.Adopting a practical approach, the Handbook traces the wide and somewhat informal notion of international energy law and covers the latest developments in the field. The expert contributors offer original research and analysis on pertinent topics such as energy investment, international energy disputes and energy trade. In addition to examining public international law issues and their application to energy activities, the Handbook also includes studies focused on private contractual arrangements and provides an angle on the human rights aspects of energy. This book will be a valuable tool for the expert audience - both academics and practitioners - and will provide students and early career practicing lawyers with a good understanding of what 'international energy law' really means.Contributors: R.J. The petroleum industry is highly specialised. Over the centuries, it has developed a large number of standard petroleum arrangements and contracts that are not familiar to all across the industry - and even less to the outside world. Each has its own detailed terms and provisions. This major work uniquely combines an encyclopaedia with commentary for the entire chain of petroleum activities. The second volume deals exclusively with midstream and downstream activities. The topics it covers include energy policies; the relevant players in the sector - from governmental authorities to national oil companies; gas storage; the regulatory and contractual frameworks governing gas and sales agreements; liquefied natural gas; pipelines; distribution networks; refineries; trading and gas stations. The book also discusses concerns and regulations regarding the environment and taxation. This approach enables all those involved in the petroleum industry to master the necessary legal terms in one publication. Both volumes feature chapters by leading experts across the globe in order to provide the best industry practices and standards. The encyclopaedia will serve as a valuable tool for lawyers, industry professionals, consultants, academics, engineers and geologists who are interested in understanding the key legal terms and provisions of the oil and gas industry.
