This book analyses the case-law of the European Court of Justice on free movement in the energy sector. Sirja-Leena Penttinen provides a comprehensive review of the interpretation and application of the free movement provisions in the energy sector by the European Court of Justice (ECJ), which allow for cross-border energy trade (free movement of goods) and energy investments (free movement of capital). Through detailed analysis of ECJ case-law, Penttinen tracks the development of the legislative framework at EU level in response to the growth of the energy sector, as well as exposing the various political and economic nuances at play. In addition, she sheds light on the dynamic relationship between the EU Member States and their regulatory autonomy, the EU legislator, the Commission and the Court in the establishment of the EU internal energy market. Taking a coherent, systematic approach, this volume will be of great interest to scholars of EU law and energy policy, as well as policymakers and professionals working in this sector.

Hydrogen is increasingly seen as a key element of Europe’s energy transition, central to both decarbonisation and energy security. This edited volume provides a comprehensive and systematic analysis of what can be called “Hydrogen Law” in the European Union and Europe, examining how law and governance are shaping the emergence of a hydrogen market. The volume brings together leading academic and practitioner perspectives to analyse the evolving regulatory framework for hydrogen across the entire value chain, from production and certification to infrastructure, markets, public funding, and international trade. It situates hydrogen within EU energy and climate law, explores key concepts such as renewable and low-carbon hydrogen, and addresses cross-cutting issues including state aid, network regulation, planning, public participation, and justice. Combining general legal analysis with regional and comparative case studies – such as hydrogen valleys, hubs, and partnerships with third countries – the volume highlights regulatory challenges, emerging solutions, and future pathways towards a coherent European hydrogen law.The book is aimed at scholars, policymakers, regulators, legal practitioners, and advanced students working in energy law, EU law, sustainability, and the energy transition, as well as stakeholders involved in hydrogen markets and infrastructure development.

Energy Transitions: Regulatory and Policy Trends highlights the recent developments in EU energy law and underlying policy aspects that shape the regulatory approach to energy.By acknowledging the multidisciplinary nature of energy law, its close relationship with policy issues and its development as an evolving new sector-specific legal field, this book reflects the multifaceted nature of EU energy law by focusing on the most topical issues of EU energy law and policy today. It examines regulatory and institutional developments in EU energy law, the case law of the Court of Justice in the field of energy, and different policy dimensions and external aspects of EU energy law. The themes covered include: capacity mechanisms, interactions between EU and international organisations and jurisdictions outside the EU, application of general EU law to the energy sector, sustainability aspects such as the current state of renewable energy support schemes and waste-to-energy processes, underground gas storage facilities, and various aspects of shale gas developments in the EU.Energy Transitions: Regulatory and Policy Trends is of importance for academics and students as well as practitioners and policy makers working in the field of energy law.
