In bestimmten Fällen führt dies zu Verfassungskonflikten. In der unionsrechtlichen Literatur finden sich Ansätze, die zivilen Ungehorsam und conscientious objection heranziehen, um das Phänomen des Verfassungskonflikts besser zu verstehen. Eine umfassende und theoretisch detaillierte Aufarbeitung fehlt jedoch bislang - und genau hier setzt Eva Rom an. Die Literatur zu zivilem Ungehorsam und conscientious objectionenthält wichtige Einsichten, die sich nutzen lassen, um einen Prüfungsrahmen zur Bewertung von Verfassungskonflikten in der Europäischen Union zu entwickeln. Als Konzepte, die eine qualifizierte Form des Widerstands beschreiben, erweisen sie sich als besonders hilfreich, um zu einem analytisch schärferen Verständnis von Verfassungskonflikten zu gelangen. Die beiden Konzepte sollen dabei nicht dazu dienen, Rechtsbrüche von Unionsrecht schematisch zu rechtfertigen. Ziel ist keineswegs eine apologetische Verteidigung von Gesetzesverstößen. Vielmehr zielt das Projekt auf Mäßigung, Differenzierung und darauf, folgende Frage präzise zu durchdenken: Unter welchen konkreten Bedingungen könnte eine entgegenstehende Entscheidung eines nationalen Verfassungsgerichts als gerechtfertigt gelten - und welche Konsequenzen hätte eine solche Einstufung?
