New innovations are created every day, but today’s business leaders are focused on finding disruptive innovations which are cheaper and lower performing than upmarket technologies. They create new markets, and challenge the status quo of existing technological thinking creating uncertainty both in the future of the innovation and the outcome of the market upheaval. Disruptive innovation is an influential innovation theory in business, but how does it affect the law?Several of these technologies have brought new ways for individuals to deal with copyright works while disrupting existing market expectations, while their ability to spawn social norms has presented challenges for legislation. Considering disruptive innovation as a class, this book examines innovations that have impacted copyright in the past, what lessons can be learned from how the law interacted with them, and how the law can successfully deal with them going forward. Creating comprehensive guidance that can be used when faced with disruptive innovations with the aim of more successful legislation, it considers whether copyright law itself has been disrupted through these innovations.Exploring whether disruptive innovations as a class have unique properties that necessitate action by legislators and whether these properties have the possibility to disrupt the law itself, this book theorises how the law should deal with disruptive innovations in general, going beyond a discussion of the regulation of specific innovations to develop a framework for how law makers should deal with disruptive innovations when faced by one.

This volume advances the claim that the FAO International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) adopted in 2001 is the only existing international agreement with the potential to promote food security, conservation of biodiversity and equity. However, for germplasm-rich countries, national interests come into conflict with the global interest. This work shows that the pursuit of national interests is counterproductive when it comes to maintaining genetic resources, food-security and rent-seeking and that optimally, the coverage of the FAO Treaty should be widened to apply to all crops.

This book explores the relationship between copyright law’s exceptions and limitations and the conflicting interests of rightsholders and users.Beginning with an overview of the history of permissions culture within photography law, the book discusses the flexibility of fair dealing exceptions and the resulting consequences of the exclusion of photographs within academic activities, projects, and ultimately the avoidance of particular research fields. Discussing the asymmetrical dependencies of stakeholders and photography researchers, the book highlights the issues with permission and fair dealing laws in the UK and offers industry-based solutions to minimise its adverse impact on academic research on photography. The book will be of interest to researchers in the field of intellectual property law, copyright law, and photography.

This book appraises postcolonial perspectives to rethink the meaning of copyright and makes suggestions for its future within the global landscape of intellectual property law.Drawing on the experience of Thailand as a case study, a country with a unique yet marginal position in discussions on colonialism, the book offers valuable insights for the international field of copyright law. Thai copyright law emerged in an era when the threat of European colonial powers inspired local ruling elites to embark on a quest for modernisation and establish a modern absolutist state. One can observe similar dynamics in the recent promotion of Thailand’s Creative Economy. Contrary to these top-down developments, the book argues for greater attention to attitudes and practices on the ground. Taking an interdisciplinary approach informed by film studies, area studies, decolonial studies, and legal sociology, the book makes a case to redefine copyright as a community resource. The book will be of interest to researchers in the field of copyright law, postcolonial and decolonial studies, and sociolegal studies.

This book tackles the lack of synchronicity between art and copyright law, proposing practical and interdisciplinary tools through which to navigate this conflict. In the last decades, high profile lawsuits have been filed against artists accused of plagiarism including Jeff Koons, Barbara Kruger and Andy Warhol. This book demonstrates how these cases are at odds with contemporary artistic reality, in which the use of antecedent visual forms is common practice. Focusing on the dichotomies of “original/copy” and of “old/new”, this work addresses this phenomenon from both theoretical and legal perspectives. Using Swiss copyright law as the main case study, the book comparatively assesses other international legal frameworks. Through understanding the origins of the conflict between art and copyright, the book highlights solutions to handle copyright cases with a new methodological approach. The book will be of interest to researchers in the field of art and copyright law, intellectual property and art.The Open Access version of this book, available at http://www.taylorfrancis.com, has been made available under a Creative Commons Attribution-Non Commercial-No Derivatives (CC BY-NC-ND) 4.0 license.

The Logic of Innovation examines not merely the supposed problem of the efficacy and relevance of intellectual property, and the nature of innovation and creativity in a digital environment, but also the very circumstances of that inquiry itself. Social life has itself become a sphere of production, but how might that be understood within the cultural and structural transformation of creativity, innovation and property? Through a highly original interlocutory and therapeutic approach to the issues in play, the author addresses the concepts of innovation and the digital by means of an investigation through literature and the imagination of new scenarios for language, business and legal reform. The book undertakes a complex inquiry into innovation and property through the wonder of Alice’s journeys in Wonderland and through the Looking-glass. The author presents a new theory of familiar production to account for the kinship that has emerged in both informal and commercial modes of innovation, and foregrounds the value of use as crucial to the articulation of intellectual property within contemporary models of production and commercialization in the digital.

Intellectual Property, Medicine and Health examines critical issues and debates including access to knowledge and medicinal products, human rights and development, innovations in life technologies and the possibility for ethical frameworks for intellectual property law and its application in public health. The central question of trust and the beneficial interests of society in the use of products of intellectual property, particularly in the fulfilment of the right to access medicinal products, emerge as key to achieving meaningful access to knowledge in health and medicine and the realization of relevant and equitable use of the benefits of scientific research in all societies. This second edition ensures that the book continues to be a rigorous academic resource in current debates in intellectual property aspects of medicine, and to characterise these debates through new and updated examples, as well as to ensure the accuracy of the book with respect to significant developments, in particular, gene-related inventions and associated litigation, stem cell research, traditional knowledge and access and benefit-sharing, as well as detailed discussions of particularly significant litigation, including Novartis v India. In this way, it continues to capture the full breadth of issues through strategic examination of particular cases. The updating ensures that recent and current issues are examined and analysed and that all law remains current and accurate, together with the revision of the resource list so that the book can act as a current research tool in these areas and indicate places to obtain further materials in the historical and legal precursors to these debates.
