Listen to the New Books Network Podcast! The phrase, “state of nature”, has been used over centuries to describe the uncultivated state of lands and animals, nudity, innocence, heaven and hell, interstate relations, and the locus of pre- and supra-political rights, such as the right to resistance, to property, to create and leave polities, and the freedom of religion, speech, and opinion, which may be reactivated or reprioritised when the polity and its laws fail. Combining intellectual history with current concerns, this volume brings together fourteen essays on the past, present and possible future applications of the legal fiction known as the state of nature. Comparative Constitutional History
Volume Two: Uses of History in Constitutional Adjudication

Constitutions are a product of history, but what is the role of history in interpreting and applying constitutional provisions? This volume addresses that question from a comparative perspective, examining different uses of history by courts in determining constitutional meaning. The book shows that there is considerable debate around the role of history in constitutional adjudication. Are, for example, historical public debates over the adoption of a constitution relevant to reading its provisions today? If a constitution represents a break from a prior repressive regime, should courts construe the constitution’s provisions in light of that background? Are former constitutions relevant to interpreting a new constitution? Through an assessment of current practices the volume offers some lessons for the future practices of courts as they adjudicate constitutional cases.Contributors are: Mark D. Rosen, Jorge M. Farinacci-Fernós, Justin Collings, Jean-Christophe Bédard-Rubin, Cem Tecimer, Ángel Aday Jiménez Alemán, Ana Beatriz Robalinho, Keigo Obayashi, Zoltán Szente, Shih-An Wang, and Diego Werneck Arguelhes.

Diplomatic Enlightenment
Spain, Europe, and the Age of Speculation

This book reconfigures the study of the origins of the Enlightenment in the Spanish Empire. Challenging dominant interpretations of the period, this book shows that early eighteenth-century Spanish authors turned to Enlightenment ideas to reinvent Spain’s role in the European balance of power. And while international law grew to provide a legal framework that could safeguard peace, Spanish officials, diplomats, and authors, hardened by the failure of Spanish diplomacy, sought instead to regulate international relations by drawing on investment, profit, and self-interest. The book shows, on the basis of new archival research, that the Diplomatic Enlightenment sought to turn the Spanish Empire into a space for closer political cooperation with other European and non-European states and empires.

Constitutional Moments

“Constitution” is a rich term in Western political culture, encompassing political and juridical doctrine as well as government practices through the ages. This volume examines “constitutional moments” in history, those occasions or episodes when significant steps were taken in the definition or redefinition of polities. Their actors were writers or politicians, rulers or ruled, who found inspiration in a distant past or instead looked towards a future to be drawn anew. This book sheds light on such moments from Ancient Greece to the present day, mostly in Europe but also in the Ottoman world and the Americas, thereby uncovering a revealing variety of constitutional thinking and action throughout history.Contributors are: Jon Arrieta, Niall Bond, Luc Brisson, Peter Cholakov, Nora Chonowski, Angela De Benedictis, F. This volume presents essays analysing the ambivalent history of the globally influential political and social concept of community and the paradigms it has engendered in academia and politics. While the term ‘community’ often evokes positive sentiments, it is also linked to oppressive regimes and exclusion.A survey of the term’s use is followed by studies of the sociologist Ferdinand Tönnies and of the use of the term in disciplines such as politics, applied linguistics, anthropology, literary theory, philosophy, and intellectual history. The volume concludes with an analysis of the application of the concept in politics in the UK, debates between liberals and communitarianists, utopianism, and African philosophy.Contributors are: Niall Bond, Christopher Adair-Toteff, Daniel Alvaro, Alexander Wierzock, Sebastian Klauke, Antonin Cohen, Jan Buts, Stéphane Vibert, Rémi Astruc, Elisabeth Bouzonviller, Françoise Orazi, Andrew Vincent, Astrid von Busekist, Robert Kramm, and Thaddeus Metz.

Monarchy, Nation and the Common Good: Patriotism in Prussia, 1756–1806

This book provides a history of Prussian state patriotism from the Seven Years’ War (1756–1763) until the Battle of Jena (1806). It argues that Prussian patriotism was not merely a prelude to German nationalism or a personality cult of Frederick the Great; rather, it was an inclusive and non-ethnic movement promoting ideals of citizenship, merit, and empowerment. Appealing to patriotism became a central method of promoting reform in a state governed by an absolute monarchy.Covering a turning point in early modern European intellectual history, this book provides a historical perspective for modern discussions on the relationship between patriotism and nationalism.

This volume by both younger and more established specialists of legal, maritime, diplomatic, and political history covers the nuanced interplay of neutrality and the law of the sea within Western, Central, and Eastern Europe, emphasising the opening up of the world in the early modern period (i.e. Africa, North America, and the Caribbean). The various faces of neutrality, both in law and politics, appear through commercial, administrative, and geopolitical practical cases and in the writings of famous legal writers. By linking up different sets of knowledge, a kaleidoscope of power configurations and arguments guides the reader through the labyrinth of trade, sea power, and negotiations.Contributors are: Stefano Cattelan, Frederik Dhondt, John Freeman, Nora Naguib Leerberg, Christian Pfister-Langanay, Leos Müller, Stephen C. Science Meets Politics: Machiavelli’s Influence and the Birth of Political Science

Machiavelli’s early influence was more penetrating than has ever been believed, and this book explains why. The surprising answer leads the reader into the depths of the history of science, connecting Machiavelli’s thought to new ways of thinking about experience, history, nature, and politics. This book argues that Machiavelli’s works resonated with readers not merely because of the political and moral questions they raised and answered, but equally because of the ways in which Machiavelli engaged with these questions. His method reinforced the readers’ own belief in the importance of an inductive and comparative approach, which relied on facts and numbers drawn from history and experience. An impressive book that, for a change, measures Machiavelli's writings not against 21st-century binary schemes, but rather against the knowledge categories and strategies of his 16th-century contemporaries and successors. Navigating skillfully among texts and authors both well-known and recondite, the author shows how the Florentine's ideas prompted and shaped a revolution in Western thought.William J Connell, Professor of History, Seton Hall UniversityIf you have ever wondered why Francis Bacon frequently quoted and lavished praise on Niccolò Machiavelli, this is the book for you. In it, Gábor Almási situates the latter with regard to the science of his time and shows that he was read initially in Italy, then in France, and finally in England as the exponent of an empiricism – divorced from theology, metaphysics, and morals – as pertinent to the study of the natural world as it is to the study of politics.Paul A.
