This book provides the first comprehensive analysis on the shared international responsibility of multiple states and international organizations that contribute to a single refoulement. It develops a set of Guiding Principles on the determination of shared responsibility for multi-actor contribution to a refoulement, based on the progressive development of the law of international responsibility. The book initially explores how destination states engage with transit states and international organizations (the European Union, NATO, the United Nations and the International Organization for Migration) in refoulements. It then analyses why existing legal instruments, notably the International Law Commission’s Articles on International Responsibility and the Guiding Principles on Shared Responsibility in International Law, fail to address such complex scenarios. Building on this critique, the book proposes new Guiding Principles and demonstrates how they can be applied in practical scenarios, offering guidance for scholars, practitioners, judges and policymakers working in human rights and refugee law.

Our earth’s supply of natural resources is depleting while mountains of waste are piling up. Killing two birds with one stone, scientists recommend a transformation towards a circular economy. Nevertheless, explicit regulation to implement such an economic model is still missing. With due regard to the global scope of the increasing this issue, the question arises whether relevant rules on these issues can be extracted from existing international law. This book examines if an integrated analysis of different fields of international law leads to an implicit obligation for states to undertake a transition towards a circular economy. By assessing the related provisions under international environmental law as well as under human rights law, it aims to reveal if they imply a mandatory economic shift. The analysis will differentiate between relevant provisions concerning the issue of resource depletion on the one hand, and the current law governing waste management on the other hand. In a second step, the environmental and social demands will be balanced with the states’ sovereignty in order to determine if an implicit obligation to transform the economy can be detected.

This book asks, if and how international human rights law can offer a legal basis for the protection of cultural heritage. Against the backdrop of the Committee on Economic, Social and Cultural Rights’ General Comment No. 21 in 2009 and the 2011 thematic report of the Special Rapporteur in the field of cultural rights on access and enjoyment of cultural heritage, this book examines one possible answer – through international human rights bodies. To this end, the research reviews the pronouncements and work of selected human rights bodies, specifically the Human Rights Council, the Human Rights Committee and the Committee on Economic, Social and Cultural Rights. Organised along the threefold structure of “meaning”, “rights”, and “obligations”, it examines the meaning of cultural heritage, the relevant rights of individuals and persons belonging to minorities and Indigenous peoples, and the corresponding state obligations vis-à-vis cultural heritage. Terroristische Bedrohungen stellen eine immense Herausforderung für unsere freiheitlich-demokratische Gesellschaft dar. Ihre Auswirkungen liegen nicht nur in der unmittelbaren Grausamkeit, sondern auch in einer möglichen Spaltung der Gesellschaft bei der Frage nach ihrer Bekämpfung. Üblicherweise werden nach Anschlägen politische Forderungen laut, insbesondere nach erweiterten Befugnissen der Sicherheitsbehörden. Dabei lässt sich in vielen Fällen feststellen: Der Attentäter war den Behörden bereits bekannt. Dieses Buch widmet sich daher der Frage, wie strukturelle Defizite in der staatlichen Terrorismusbekämpfung vermieden werden können, die eben solche Fälle begünstigen. Das Augenmerk liegt dabei auf der Zusammenarbeit der Sicherheitsbehörden, deren verfassungsrechtliche Grundlagen dargestellt werden. Anhand von Fallstudien zu den Fällen des sog. NSU und dem Anschlag auf dem Berliner Breitscheidplatz 2016 analysiert das Buch, welche Probleme dabei in der Vergangenheit aufgetreten sind. Für die aufgezeigten strukturellen Defizite werden mögliche Reformoptionen entwickelt und im Lichte verfassungsrechtlicher Vorgaben bewertet. Der Schwerpunkt liegt dabei auf der Einführung von Weisungsbefugnissen des Bundeskriminalamts und des Bundesamts für Verfassungsschutz gegenüber den jeweiligen Landesbehörden einerseits und der Umstrukturierung der Nachrichtendienste andererseits.
