This study aims to examine the substantive applicable law in different arbitral tribunals, especially the ICSID and the Iran-US Claims Tribunal. Additionally it examines the role of international law and whether it has supremacy over national laws. To that end, this publication is mainly based on case studies, the most cited ICSID and Iran-US Claims Tribunal cases. Furthermore, it addresses scientific works on this topic with regard to various arbitration rules and in particular to the applicable law.

This book provides a comprehensive basis for the contractual transfer of immovables under Kosovo law. In particular, it aims to bring near the readers the influence of contract law rules in the transfer of immovables. Furthermore, it addresses the legal relationship of contract and property law with other fields of civil law during the contractual transfer of immovable.

Immer häufiger tragen die Parteien zivilrechtlicher Streitigkeiten ihre Auseinandersetzung parallel vor Gerichten verschiedener Staaten aus. Solche multi-fora disputes stehen im Widerspruch zu grundlegenden Zielen des Internationalen Zivilprozeßrechts. Die Arbeit analysiert die unterschiedlichen Lösungsansätze, die nationale Rechtsordnungen und internationale Übereinkommen bislang zur Bewältigung positiver Kompetenzkonflikte entwickelt haben. Dabei wird der Versuch unternommen, eine konsensfähige Regelung für das von der Haager Konferenz für Internationales Privatrecht derzeit diskutierte weltweite Anerkennungsübereinkommen zu entwerfen.

The concept of delocalised arbitration tends to evade any active judicial control over arbitral awards at the place of arbitration. The judicial control over arbitral awards is nowadays reduced to the extent of their conformity with transnational public policy. That is the reason why the losing party to the arbitral proceedings tries to invoke the procedural human rights as a minimum protective standard under international human rights law. This study sheds light on the question as to whether international human rights law is to be applied to the international commercial arbitration. Moreover, it specifies some serious violations of procedural human rights occurring in the arbitral process and determines the responsibility of states for tolerating such violations which take place within their jurisdiction.
