"Legitimation by Constitution" is the phrase, coined by distinguished authors Frank Michelman and Alessandro Ferrara, for a key idea in Rawlsian political liberalism of a reliance on a dualist form of democracy-a subjection of ground-level lawmaking to the constraints of a higher-law constitution that most citizens could find acceptable as a framework for their politics-as a response to the problem of maintaining a liberally just, stable, and oppression-freedemocratic government in conditions of pluralist visionary conflict.Legitimation by Constitution recalls, collects, and combines a series of exchanges over the years between Michelman and Ferrara, inspired by Rawls'' encapsulation of this conception in his proposed liberal principle of legitimacy. During the twentieth century, the view that assertions and norms are valid insofar as they respond to principles independent of all local and temporal contexts came under attack from two perspectives: the partiality of translation and the intersubjective constitution of the self, understood as responsive to recognition. Defenses of universalism have by and large taken the form of a thinning out of substantive universalism into various forms of proceduralism. Alessandro Ferrara instead launches an entirely different strategy for transcending the particularity of context without contradicting our pluralistic intuitions: a strategy centered on the exemplary universalism of judgment. Whereas exemplarity has long been thought to belong to the domain of aesthetics, this book explores the other uses to which it can be put in our philosophical predicament, especially in the field of politics.After defining exemplarity and describing how something unique can possess universal significance, Ferrara addresses the force exerted by exemplarity, the nature of the judgment that discloses exemplarity, and the way in which the force of the example can bridge the difference between various contexts. Paradójicamente, en la época histórica en la que ha logrado convertirse en el horizonte compartido por la mayoría de la humanidad, se ve amenazada por inquietantes procesos de desdemocratización o reelitización y ha de afrontar el populismo, la desafección y unas condiciones sociales, culturales y económicas mucho más inhóspitas que las del pasado reciente.La historia podría tomar cualquier camino. Podríamos asistir a la confrontación entre dos modelos poco atractivos para cualquier demócrata, entre los regímenes neoliberales, que utilizan los vestigios de la democracia representativa para centrar la atención pública en los mercados financieros, y regímenes como el de China, donde el partido y las élites burocráticas tratan de mantener el consenso asegurando mayores niveles de consumo y silenciando el anhelo democrático.Pero, al mismo tiempo, el mundo global podría ser el escenario de un desarrollo completamente distinto: las democracias maduras de Occidente, tras la dura lección de la presente crisis neoliberal, podrían desarrollar formas de contener el poder neoabsolutista de los mercados financieros e inventar nuevas estrategias para reafirmar la primacía de la política y la participación ilustrada de cada ciudadano.Entre el presente y estas dos perspectivas opuestas se abre un espacio de reflexión a la que este libro pretende contribuir. Partiendo del marco normativo desarrollado por Rawls y recurriendo a las fuentes estéticas de la normatividad investigadas por el propio Ferrara en el pasado -la ejemplaridad, el juicio, la imaginación-, el autor mantiene que el liberalismo político es el marco filosófico más capacitado para abordar y entender la compleja interacción que existe entre la democracia y lo que él denomina la normatividad de la identidad.

"Autenticidad reflexiva" analiza la noción de validez del juicio moral después del giro lingüístico de la filosofía, en la llamada época postmoderna. Ferrara recupera el concepto aristotélico de "prudencia" y el de "juicio reflexionante" estético de Kant, para sustituir la concepción moderna de autonomía del sujeto por la de autenticidad, como fundamento de los juicios morales. Para ello analiza este concepto de autenticidad a partir de su uso en el psicoanálisis, la sociología y la teoría de la obra de arte.

La Crítica del juicio de Kant inaugura, según Alessandro Ferrara, un paradigma nuevo para el pensamiento de la validez y la normatividad: el paradigma del juicio. Según Ferrara, la idea de validez normativa que Kant presupuso en su concepto de juicio reflexivo extiende su significación más allá del reino de la estética y proporciona un modelo coherente e inspirador para disciplinas diversas, entre ellas la teoría política. Nos encontramos en un mundo en que hay en oferta teorías y concepciones con pretensiones de universalidad que no pueden dar respuesta a nuestra intuición de la pluralidad de marcos interpretativos, y teorías y concepciones que parten de asunciones pluralistas que fallan a la hora de justificar nuestro impulso hacia el universalismo. Para el autor, la estética, y dentro de ella el juicio reflexivo, ejerce el papel de modelo de validez que, a través de la noción de validez ejemplar, es capaz de aunar lo que ninguna doctrina filosófica contemporánea es capaz de reconciliar: universalismo y pluralismo. La respuesta a la pregunta "¿Cómo puede una teoría o concepción nacida en el "aquí y ahora" ser pertinente "allí y entonces"?" se halla según Ferrara en la normatividad del ejemplo: lo que surge de un contexto histórico y cultural (ya sea una teoría, una constelación de valores culturales, una institución política) puede ejercer fuerza lógica fuera de su contexto original mediante una entrada en relación de congruencia excepcional (de autenticidad) con la subjetividad, individual o colectiva, que la ha producido.

In Rousseau and Critical Theory, Alessandro Ferrara argues that among the modern philosophers who have shaped the world we inhabit, Rousseau is the one to whom we owe the idea that identity can be a source of normativity (moral and political) and that an identity's potential for playing such a role rests on its capacity for being authentic. This normative idea of authenticity brings unity to Rousseau's reflections on the negative effects of the social order, on the just political order, on education, and more generally, on ethics. It is also shown to contain important teachings for contemporary Critical Theory, contemporary views of self-constitution (Korsgaard, Frankfurt and Larmore), and contemporary political philosophy.
