Within the discipline of criminology and criminal justice, relatively little attention has been paid to the relationship between criminal law, punishment, and imperialism, or the contours and exercise of penal power in the Global South. Decolonizing the Criminal Question is the first work of its kind to comprehensively place colonialism and its legacies at the heart of criminological enquiry.By examining the reverberations of colonial history and logics in the operation of penal power, this volume explores the uneasy relationship between criminal justice and colonialism, bringing relevance of these legacies in criminological enquiries to the forefront of the discussion. It invites and pursues a better understanding of the links between imperialism and colonialism on the one hand, and nationalism and globalization on the other, by exposing the imprints of these links on processes of marginalization, racialization, and exclusion that are central to contemporary criminal justice practices. Policing the Borders Within offers an in-depth, comprehensive exploration of the everyday working of inland border controls in Britain, informed by extensive empirical material viewed through the lens of wide-ranging interdisciplinary debates. In particular, this book examines afresh the relationship between policing, borders, and social order, in terms of migration policing. By charting this new landscape of everyday contemporary policing, this book's main goal is to advance understanding of novel forms of law enforcement in a global age. These new forms of collaboration direct attention to the way in which frontline enforcement agents, through their everyday work, not only enforce the border, but recreate it.As the book argues, the emphasis on borders and migration controls and the growing importance of it within inland policing is a symptom of the new demands and challenges facing the state in exercising authority in a fast-moving, interconnected world, and its attempt to offer a semblance of order. Such challenges result in practice of random, capricious, informal, and arbitrary operation of power, which relies on non-rational elements to solve policing problems. Through an ethnography of the worlds of police and immigration officers, this book dissects the ethical, political, legal, and social dilemmas, and explores the tensions and contradictions of maintaining order in a deeply unequal globalized world. The new impetus to police migration is an insightful entry point to understand law enforcement in a global age.

The criminalization of immigration status has historically served functions of exclusion and control against those who defy the state’s powers over its territory and population. In the last two decades, the powers to exclude and punish have been enhanced by the expansion of the catalogue of immigration offences and their more systematic enforcement. This book is the first in-depth analysis on criminal offences in Britain, and presents original empirical material about the use of criminal powers against suspected immigration wrongdoers. Based on interviews with practitioners and staff at the UK Border Agency and data from court cases involving immigration defendants, it examines prosecution decision making and the proceedings before the criminal justice system. Crimes of Mobility critically analyses the criminalization of immigration status and, more generally, the functions of the criminal law in immigration enforcement, from a legal and normative perspective. This edited collection advances a reconceptualisation of state power through emotions. Methodologically, it rethinks the study of the state from the bottom up, by seeking contributions that engage with performances and enactments of state power at the ground level, by frontline staff in direct contact with marginalised populations, and those that reflect on encounters with symbols and practices of state power. Conceptually, it advances a new theory of state power which places values and affects at the heart of its analysis.In doing so, it seeks to make a crucial intellectual intervention in the study of the people, images and processes involved in the governance of social marginality in various institutional settings – criminal justice, immigration and asylum bureaucracies, the welfare system, the care sector, etc. – to explore how emotions are mobilised, how their expression in contemporary institutional settings of state power connects to broader moral and affective economies, the contradictions, and dilemmas they embody and reproduce, and the implications of these emotionalised forms of governance for state praxis and theory.The Embodied State will therefore appeal to students and scholars of critical criminology, political sociology, anthropology, migration and border studies, and penology.
