Over the last few decades, the issue of historical/ non-recent institutional abuses has resonated in a range of Western states and churches. Despite the recent proliferation of 'justice' responses to such abuses including prosecutions and civil litigation, inquiries, redress and apologies, it is a subject which is insufficiently understood in the literature. Set against the complexities of the legal, historical, cultural, and political realities of addressing non-recent institutional abuses, Transforming Justice Responses to Non-Recent Institutional Abuses critically examines these justice responses across Northern Ireland and the Republic of Ireland. Bringing together the voices of victim/survivors of non-recent institutional abuses with legal actors, academics, media professionals, and church and state actors on their experiences of justice processes, this book reframes discourses on accountability and responsibility and considers how to improve justice processes at the level of praxis and increase engagement between victim/survivors and institutional actors.Drawing on interdisciplinary literature related to restorative, transitional, and transformative justice and analysis of primary research, the book advances analysis of the role of innovative justice in this space and a new approach to justice which bridges the accountability gap between seeking and achieving justice for non-recent institutional abuses while improving outcomes for victims and survivors. 'Grooming' and the Sexual Abuse of Children: Institutional, Internet and Familial Dimensions critically examines the official and popular discourses on grooming, predominantly framed within the context of online sexual exploitation and abuse committed by strangers, and institutional child abuse committed by those in positions of trust.Set against the broader theoretical framework of risk, security and governance, this book argues that due to the difficulties of drawing clear boundaries between innocuous and harmful motivations towards children, pre-emptive risk-based criminal law and policy are inherently limited in preventing, targeting and criminalising 'grooming' behaviour prior to the manifestation of actual harm. Through examination of grooming against the complexities of the onset of sexual offending against children and its actual role in this process, the author broadens existing discourses by providing a fuller, more nuanced conceptualisation of grooming, including its role in intra-familial and extra-familial contexts. There is also timely discussion of new and emerging forms of grooming, such as 'street' or 'localised' grooming, as typified by recent cases in Rochdale and Oldham, and 'peer-to-peer' grooming.The first inter-disciplinary, thematic, and empirical investigation of grooming in a multi-jurisdictional context, 'Grooming' and the Sexual Abuse of Children draws on extensive empirical research in the form of over fifty interviews with professionals, working in the fields of sex offender risk assessment, management or treatment, as well as child protection or victim support in the four jurisdictions of the United Kingdom and the Republic of Ireland. Winner of the 2008 British Society of Criminology Book Prize Sex offenders, particularly those who offend against children, feature prominently in contemporary law and order debates. Child sexual abuse is a small component of the broader category of 'gendered and sexualised violence' which causes significant trauma for victims yet continues to evade conventional approaches to justice. This is evidenced not only by the low number of prosecutions, due mostly to low levels of reporting and evidential difficulties at trial, but also by the failure of the justice system to prevent re-offending, largely due to the limited availability and effectiveness of prison treatment programmes. Following Braithwaite's dichotomy of 'reintegrative' and 'disintegrative' shaming, this book argues that contemporary popular and state-led responses to the risk posed by sex offenders are largely disintegrative in nature. At best, the offender may be labelled, stigmatised and ostracised from the community, while at worst, he may be subjected to violence and vigilante action and ultimately return to offending behaviour.The failure of these retributive responses means there is considerable scope for exploring alternative forms of justice and their potential for improving the outcome for victims, offenders and communities affected by sexual offences. This book examines the controversy of whether restorative justice can be applied to child sexual abuse as one of the most intractable of contemporary societal problems, and if so, what special considerations might apply. Although restorative schemes with sex offenders are in short supply, a few initiatives have developed in Canada and parts of the United States which have effected significant benefits in 'reintegrative shaming.' The book examines whether such ad hoc schemes may be of general application with child sexual abuse and whether they may be implemented on a more holistic basis.
