El texto que se presenta es un estudio escrito por Mildred Hartmann acerca de los primeros años de funcionamiento del sistema acusatorio en Colombia, que fue realizado durante el año 2007 y que da cuenta de las dos primeras etapas de la implementación de esta importante reforma. El Centro de Estudios de Justicia de las Américas apoyó el desarrollo de este estudio como lo ha hecho con otros similares en los demás países en que este tipo de reformas ha tenido lugar, y lo ha hecho en el convencimiento de que la única manera de que una reforma tan compleja sea exitosa, consiste en que sus primeros resultados sean expuestos y examinados en un amplio debate público, con el fin de hacer posible la identificación de las debilidades que el proceso necesariamente tendrá, así como de incentivar que los organismos responsables desarrollen las iniciativas necesarias para superarlas. La experiencia muestra que la suerte de un nuevo sistema de justicia no depende tanto de aciertos iniciales ni de la mayor o menor virtud de talo cual norma, sino más bien de la posibilidad de que a partir del inicio del nuevo sistema, tenga lugar un proceso de análisis y de mejoramiento progresivo, que ojalá se traduzca en una verdadera cultura institucional de autocrítica y del desarrollo de capacidades institucionales de diseño de intervenciones destinadas a superar los problemas detectados. El trabajo de Mildred hace exactamente lo que es necesario para dar lugar al debate que se requiere. Identifica con claridad una serie de aspectos relevantes del funcionamiento del nuevo sistema de justicia, tanto positivos como problemáticos, los ilustra claramente no sólo con sus opiniones, sino con datos que permiten comprenderlos mejor, pero que además no dejan margen de duda sobre la existencia.
