This Research Handbook examines the complex issues faced by migrants and refugees in securing their human rights. By challenging and reformulating the crisis narrative often perpetuated by states and international organizations, it provides a cutting-edge, in-depth investigation of key themes central to the human rights implications of migration.Adopting an intersectional, interdisciplinary and gendered approach, the Research Handbook identifies the human rights challenges faced by migrants and refugees, especially women, girls and LGBTIQ+ persons, as well as the complex questions faced by states and supranational institutions in addressing diversity and managing human mobility. La evolución experimentada por la sociedad española a partir de la promulgación de la Constitución de 1978 ha tenido un claro reflejo en el pensamiento social, principalmente en los roles atribuidos a la mujer, así como en una nueva concepción de la sexualidad, cuyos efectos han irradiado en el Código Penal y en el tratamiento que se ha dispensado al llamado Derecho Penal sexual, motivado principalmente por el desarrollo de las tesis feministas. Es más, la aludida transformación experimentada en España hace cuarenta años se plasmó en una nueva concepción de la mujer, atribuyéndole un nuevo rol, pasando de ser definida por "su condición de cuerpo sexuado y moral virtuosa", merecedora de una intensa protección penal que no se dispensaba al varón, hasta ser considerada un sujeto con plena capacidad de autodeterminación sexual, con plenos derechos y libertades. De este modo, la libertad sexual deviene en bien jurídico objeto de protección integral que se identifica con la prestación del consentimiento libre, revocable y para unas prácticas concretas. El mutuo acuerdo se establece como marco de libertad y el derecho a decidir sobre el propio cuerpo como elemento central.
