Dicho de otra manera, lo que es objeto de discusión es el alcance de dicho poder, sus límites y las diferentes formas que reviste la interacción entre los árbitros y los poderes públicos; no la razón de ser del arbitraje. Sin embargo, como casi siempre sucedió con las instituciones políticas y jurídicas que ocuparon un lugar primordial en determinado contexto histórico, arribar a un elevado grado de desarrollo e Influencia (cuando no de preeminencia) suele implicar, paradójicamente, la generación de riesgos para el mantenimiento y hasta para la propia supervivencia de dichas instituciones. El arbitraje no está exento del peligro de morir de éxito.
