Though the EU has tried to place human rights and democracy at the heart of its external action, there are serious concerns about its capacity to have a significant impact on the situation of human rights and human rights defenders as well as on the democratization processes taking place in different regions of the world.This edited volume sheds light on the achievements of EU policies and programmes in the field of human rights and democracy, also taking into account the challenges ahead. Analysing the changing global context’s effect on the ability of the EU to have a meaningful impact in the field of human rights and democratization, it examines relevant policies and programmes of the EU to see their impact on the ground. Combining various methodologies, the authors examine primary agreements and other EU documents, secondary sources (such as evaluations of EU’s policies and programmes) in the field of human rights and democracy promotion, and have interviewed EU officials, academics and other key stakeholders. Una de las características más relevantes del acelerado proceso de globalización que estamos viviendo es el progresivo desmantelamiento de las fronteras a la actividad económica. A la crisis de un Estado-nación que se ve desbordado por la creciente autonomía de la economía se une la incapacidad del Derecho para regular adecuadamente la gobernanza global. A mediados de los 90 una pequeña, pobre y aislada comunidad indígena de la Costa Atlántica de Nicaragua, la comunidad Awas Tingni del pueblo Mayangna, acudió al sistema interamericano para denunciar al Gobierno nicaragüense por haber realizado concesiones para la explotación de madera en el territorio ancestral de la comunidad sin su consentimiento. La decisión de la Corte Interamericana de Derechos Humanos, situada en San José de Costa Rica, en el Caso de la Comunidad Awas Tingni contra Nicaragua (agosto de 2001) ha sentado un precedente muy prometedor para la evolución del derecho de los pueblos indígenas sobre sus tierras y recursos naturales en el panorama jurídico internacional.
