Das Organisationsverschulden wurde durch das Reichsgericht im Bereich des Deliktsrecht entwickelt und seitdem auf immer mehr Bereiche ausgedehnt. Der Begriff Organisationsverschulden erfreut sich in der Rspr. großer Beliebtheit. Im Nachhinein steht leichthin fest, welche Maßnahmen den Schaden verhindert hätten. Ungeklärt ist allerdings sowohl in Rechtsprechung als auch Literatur, was Organisationspflichten und die Voraussetzungen für ein Organisationsverschulden sind, sowie ob ein einheitliches Organisationsverschulden existiert. Der Verfasser legitimiert, systematisiert und konkretisiert das Organisationsverschulden und untersucht, ob von einem einheitlichen Organisationsverschulden innerhalb und außerhalb des Deliktsrechts die Rede sein kann.

Die interdisziplinäre Arbeit befasst sich mit automatisierter Rechtsanwendung und ihren Grenzen am Beispiel des automatisierten/autonomen Fahrens. Es wird untersucht, ob der Regelungsgehalt der verhaltensrechtlichen Verkehrsvorschriften von StVG/StVO für das automatisierte/autonome Fahren ausreichend ist. Der Autor arbeitet dazu die gesetzlichen Anforderungen heraus und zeigt auf, wie diese umgesetzt werden müssen. Anhand der Dilemmasituation wird analysiert, welche Anforderungen an die Programmierung erwachsen. Der Autor untersucht sodann am Beispiel des Abbremsens, ob Fahrzeuge die geltenden Verkehrsvorschriften umsetzen können. Mittels der Formalisierung des Rechts zeigt er schließlich auf, wie Gesetze angepasst werden müssen, damit automatisierte Rechtsanwendung möglich ist.
