The German linguists Johannes Schmidt (1843-1901) and Hugo Schuchardt (1842-1927) sought to answer many questions relating to the development of Indo-European languages, which are all believed to be descended from a single common ancestor. Schmidt's Verwantschaftsverhältnisse was originally published in 1872 and Schuchardt's Über die Lautgesetze followed in 1885; here they are reissued together in one volume. Schmidt's work developed the 'wave model' of language change, to which Schuchardt also subscribed. According to this theory, linguistic innovations spread outwards concentrically like waves, which become progressively weaker as time elapses and the distance from their point of origin increases. Since later changes may not cover the same area, there may be no sharp boundaries between neighbouring languages or dialects. This theory stood in opposition to the tree model and the doctrine of sound laws propounded by the Neogrammarian school of linguists, which is roundly critiqued in Schuchardt's contribution.

In der EU-Grundrechtecharta wurde mit den "Grundsätzen" eine neue Grundrechts-Kategorie geschaffen. Johannes Schmidt geht den bisher unbeantworteten Fragen nach, welche Rechtswirkungen diese Normen haben und wie mit ihnen umzugehen ist. Für die Analyse der Grundsätze entwickelt er zunächst ein universal gültiges Strukturmodell für Grundrechtsnormen, das im Wesentlichen auf der "Theorie der Grundrechte" von Robert Alexy aufbaut. Dieses Modell erlaubt es, die Rechtswirkungen der Grundsätze detailliert zu beschreiben, was im zweiten Teil der Arbeit geschieht. Ausführlich wird dabei auf die Frage eingegangen, ob sich subjektive Rechte aus den Grundsätzen ableiten lassen. Im letzten Teil stellt der Autor für die Praxis wichtige Leitlinien für den Umgang mit den Grundsätzen auf. Neben der besonders wichtigen Frage der Justiziabilität wird auch eine Einordnung der Chartanormen vorgenommen.

Spielräume sind im Recht allgegenwärtig. Sie machen das Recht flexibel, schwächen aber auch seine Steuerungskraft. Im öffentlichen Recht spielt die Offenheit der Abwägung von Prinzipien eine herausgehobene Rolle. Die daraus resultierenden Spielräume liegen vielen grundrechtlichen Fragestellungen des Verfassungsrechts, über den Grundsatz der Verhältnismäßigkeit aber auch einer Vielzahl verwaltungsrechtlicher Probleme zugrunde. Matthias Klatt und Johannes Schmidt nehmen die Frage der Spielräume im Rahmen der Abwägung von Prinzipien auf. Die vorliegende Schrift steht in der Tradition der Prinzipientheorie Robert Alexys. Die Autoren entwickeln Alexys Spielraumdogmatik aber in wesentlichen Teilen weiter und übertragen sie auf neue Rechtsgebiete wie das Verwaltungsrecht und das Europarecht. Die epistemischen Spielräume, die durch Unsicherheit von Wissen entstehen, stehen dabei im Zentrum.

Die Normen des Brüsseler Übereinkommens (EuGVÜ) und seines Nachfolgers, der Brüssel-I-Verordnung (EuGVVO), bilden mit ihren Regelungen zu Fragen der Zuständigkeit und Anerkennung seit Jahrzehnten den Kernbestand des europäischen Zivilverfahrensrechts. Deren Auslegung ist dem Europäischen Gerichtshof anvertraut, der sich dabei regelmäßig auf das Prinzip der Rechtssicherheit beruft. Ist dieses Argument tragfähig? Johannes Schmidt untersucht unter verschiedenen Blickwinkeln, ob und inwieweit der EuGH Rechtssicherheit erreicht. Dabei fragt er einerseits nach der Berechenbarkeit der Rechtsprechung des EuGH, andererseits nach den Folgen der vom EuGH gewonnenen Ergebnisse für die Rechtsanwender. Die Analyse mündet in ein kritisches Fazit, an das sich die Suche nach Erklärungen und Verbesserungsmöglichkeiten, insbesondere stilistischer Art, anschließt.

Zum siebzehnten Mal bietet das Herder Jahrbuch eine Auswahl aktueller Forschung zu Johann Gottfried Herder. Die diesjährige Ausgabe versammelt Forschungsbeiträge zu Herders Gedanken zum "Buch der Natur", zum Journal meiner Reise und zu Herders Rezeption der Briten Locke, Hutcheson, Home und Burke sowie zu seiner Auseinandersetzung mit Swift (einschließlich der Transkription zweier unveröffentlichter Handschriften Herders). Auch in diesem Jahr präsentiert das Herder Jahrbuch die Fortführung der umfassenden Herder-Bibliographie von Primär- und Sekundärliteratur inklusive Register. Vier Rezensionen zu aktueller Herder-Literatur beschließen den Band. Das Herder Jahrbuch erscheint im Auftrag der Internationalen Herder-Gesellschaft im 2-Jahres-Rhythmus und bietet disziplinübergreifend Forschungsbeiträge in deutscher und englischer Sprache zu allen Aspekten von Herders Werk sowie zu dessen entstehungs- und wirkungsgeschichtlichen Kontexten.

Franz Lenk ( 898– 9 8) was one of the most well-known painters of Neue Sachlichkeit. The publication offers a current perspective on his oeuvre and artistic career. It poses questions not only about his artistic role models, but also about his worldview and how it is manifested in his painting. For instance, Lenk's ambivalent position during the years from 933 to 945 is analyzed and assessed within the context of the events of the time. Biographical and art-historical insights, including about the group " Die Sieben" (The Seven) and his participation in the exhibitions of the Carnegie Institute in Pittsburgh in the 93 s, are incorporated into the presentation.
