Der Facebook-Fall des Bundeskartellamts polarisiert. Im Mittelpunkt der Diskussion steht die Frage, inwieweit Datenschutzrechtsverstöße die Grundlage für einen kartellrechtlichen Konditionenmissbrauch bilden können.Die Autorin erarbeitet anhand des Schutzzwecks und der rechtlichen Einbettung des Konditionenmissbrauchs einen Kriterienkatalog für die Berücksichtigungsfähigkeit außerkartellrechtlicher Rechtsverstöße in der Konditionenmissbrauchskontrolle. Datenschutzrechtsverstöße dienen dabei als Aufhänger. Außerdem wird die Kompetenzproblematik dargestellt, die sich aus der Bewertung des Datenschutzrechts durch zwei unabhängige Behörden ergibt.Das Ergebnis ist, dass außerkartellrechtliche Rechtsbrüche unter bestimmten Voraussetzungen, die bei Datenschutzrechtsverstößen vorliegen, den Unangemessenheitsmaßstab für die Konditionenmissbrauchskontrolle bilden können, das Bundeskartellamt einen Datenschutzrechtsverstoß seit Inkrafttreten der DS GVO aber nicht mehr selbst prüfen darf.
