Betroffene stehen Persönlichkeitsrechtsverletzungen im Netz oft hilflos gegenüber: der verletzende Inhalt wird mitunter gelöscht, Auskunft über die Identität der Nutzer:innen erhält der Betroffene jedoch nicht ohne Weiteres. Der allgemeine Auskunftsanspruch scheiterte lange an einer datenschutzrechtlichen Befugnisnorm. Es bestand nur die (erfolglose) Möglichkeit strafrechtlich gegen Unbekannt vorzugehen, um so an Informationen zu gelangen. Im Ergebnis lief der zivilrechtliche Schutz jahrelang schlicht leer. Die zwischenzeitliche Nachbesserung des Gesetzgebers vermag daran kaum etwas zu ändern. Zum Schutz des grundrechtlich verbürgten Persönlichkeitsrechts bedarf es der Einführung eines eigenständigen zivilrechtlichen Drittauskunftsanspruches.
