The EU has become a powerful migration policy actor. As a result, European migration policy is increasingly coming into conflict with its obligation to protect human rights. This open access volume names the most urgent challenges, develops the relevant legal standards and makes proposals for reform. For the time being, the political project of basing the European Union on a document entitled 'Constitution' has failed. The second, revised and enlarged edition of this volume retains its title nonetheless. Building on a scholarly rather than black-letter law account, it shows European constitutional law as it looks following the Treaty of Lisbon, with the EU's foundational treaties mandating the exercise of public authority, establishing a hierarchy of norms and legitimising legal acts, providing for citizenship, and granting fundamental rights. In this way the treaties shape the relations between legal orders, between public interest regulation and market economy, and between law and politics. The contributions demonstrate in detail how a constitutional approach furthers understanding of the core issues of EU law, how it offers theoretical and doctrinal insights, and how it adds critical perspective. Jürgen Bast schlägt vor, das überkommene Ausländer- und Asylrecht als ein modernes, sozialgestaltendes Migrationsrecht zu verstehen, dessen Zentrum die ordnungsrechtliche Steuerung der Zuwanderung bildet: das Aufenthaltsrecht. Seine Analyse nutzt rechtsgeschichtliche, politikwissenschaftliche und soziologische Erkenntnisse, um fünf konkurrierende Perspektiven auf das Migrationsgeschehen zu identifizieren, die im Recht aufeinandertreffen. Auf dieser Grundlage entfaltet er die völker- und verfassungsrechtliche Rahmenordnung für deutsche und europäische Gesetzgebung und zeigt Ordnungsmuster der verwaltungsrechtlichen Steuerung der Arbeits-, Familien- und Fluchtmigration auf. Als Entscheidung von großer Tragweite erweist sich, dass das geltende Aufenthaltsgesetz allen Zuwanderern Passagen zur Einwanderung eröffnet, indem es ein Daueraufenthaltsrecht in Aussicht stellt.

Die Handlungsformen gehörten bislang zu den systematisch unaufgearbeiteten Teilen des Unions- und Gemeinschaftsrechts. Jürgen Bast legt eine Grundlagenstudie vor, die die Handlungsformen der EU dogmatisch erschließt und sie zu weiteren Zentralkategorien des europäischen Verfassungsrechts - Organe, Kompetenzen, Rechtsschutz - in Beziehung setzt. Der Schlüssel zum Verständnis der verschiedenen Handlungsformen ist ihr je spezifischer Wirkungsmodus: ein charakteristisches Bündel von rechtlichen Wirkungen, die ein Rechtsakt aufgrund seiner formalen Identität entfalten kann. Als Fallstudie entwickelt die Arbeit detailliert das Rechtsregime des Beschlusses. Mit dieser Handlungsform, die in der Rechtsetzungspraxis entwickelt wurde, können die Organe der Union verbindliche Festlegungen treffen, ohne den Mitgliedstaaten oder den Bürgern rechtliche Verpflichtungen aufzuerlegen.

Sie umfasst nunmehr auch Beiträge zu den Verfassungsorganen, zur auswärtigen Gewalt, zum Rechtsschutz, zur Arbeitsverfassung sowie zum Raum der Freiheit, der Sicherheit und des Rechts.
