Studienarbeit aus dem Jahr 2023 im Fachbereich Jura - Zivilrecht / BGB AT / Schuldrecht / Sachenrecht, Note: 2,3, Technische Universitat Carolo-Wilhelmina zu Braunschweig, Sprache: Deutsch, Abstract: Aufgrund der stark gestiegenen Preise fur Warme stellt sich die Frage, was Vermieter rechtlich tun konnen, wenn sie eine Betriebskostenpauschale im Mietvertrag vereinbart haben, in der auch Heizkosten fur Gas uber die monatliche Betriebskostenpauschale abgegolten werden. Ziel dieser Arbeit ist es daher, die rechtlichen Handlungsmoglichkeiten der betroffenen Vermieter bei bestehenden Wohnraummietvertragen anhand von zwei Beispielmietvertragen aufzuzeigen. In Kapitel B beschreibt die vorliegende Seminararbeit die Grundzuge des deutschen Wohnraummietrechts. Dafur wird ergrundet, wie ein Mietvertrag rechtlich einzuordnen ist und wie er abgeschlossen als auch beendet werden kann. Das Kapitel C beantwortet die Frage, wie die Umlage der Betriebskosten im Mietvertrag gestaltet werden kann und wie die Heizkostenverordnung die Vereinbarung einer Betriebskostenpauschale fur Warme beeinflusst. Das Kapitel D zeigt die Entwicklungen am Gasmarkt auf und beantwortet die Frage nach den tatsachlichen Kostensteigerungen anhand eines Beispiels. Im Kapitel E werden die rechtlichen Handlungsmoglichkeiten von Vermieter mithilfe von zwei Praxisbeispielen analysiert und die Umsetzbarkeit bewertet.
