Die Informationserhebung folgt im Strafverfahren einerseits und im Verwaltungsverfahren der Wirtschaftsaufsicht andererseits unterschiedlichen normativen Vorgaben. Bei einem ungehinderten Informationsfluss von einem Verfahren in das andere besteht die Gefahr, dass die Vorgaben für die Informationserhebung und das darin verkörperte Schutzkonzept unterlaufen werden. Auf der Grundlage eines Strukturvergleichs zwischen Strafverfahren und Verwaltungsverfahren arbeitet Martin Böse die Grenzen heraus, die staatlichen Eingriffen zur Erhebung und Verarbeitung personenbezogener Daten durch die verfassungsrechtlich garantierten Grund- und Verfahrensrechte des Einzelnen gesetzt sind. Weiter werden die bestehenden gesetzlichen Befugnisse zur verfahrensübergreifenden Verwendung von Informationen auf ihre Vereinbarkeit mit der Verfassung überprüft. Dabei zeigt sich insbesondere bei der Untersuchung des Schweigerechts im Strafverfahren, dass die gesetzlichen Regelungen zum Teil gegen die verfassungsrechtlichen Vorgaben verstoßen; zum Teil kann dieses Ergebnis allerdings durch eine verfassungskonforme Auslegung vermieden werden.
