Notstände sind oftmals nicht für den Staat, sondern für die Freiheits- und Gleichheitsrechte der Menschen ein existenzielles Risiko. Ausgehend von dieser Beobachtung analysiert Max Milas die menschenrechtliche Notstandsspruchpraxis in Europa, Amerika, Afrika und den Vereinten Nationen. Er zeigt, dass die menschenrechtlichen Kontrollinstitutionen in ihrer Notstandsspruchpraxis größtenteils einheitliche Notstandsmaßstäbe etabliert haben, die sie trotz unterschiedlicher Normgrundlagen einheitlich anwenden. Die regionale Ausdifferenzierung der Menschenrechte führt für das Notstandsrecht nicht zu einem fragmentierten Menschenrechtsschutz. Stattdessen haben die menschenrechtlichen Kontrollinstitutionen ein vereinheitlichtes Notstandsrecht geschaffen, das situativ angepasst angewendet wird und - vermittelt über die Legitimität der Kontrollinstitutionen - dem Schutz des jeweiligen Menschenrechtssystems dient.Zur Arbeit gehört ein Online-Appendix, der unter folgender DOI abrufbar ist:https://doi.org/10.1628/978-3-16-164840-3-appendix
