Where contemporary developments have significantly altered the implementation methods of, and relationship between, human rights law and international humanitarian law, this timely book looks at the future challenges of protecting human rights during and after armed conflicts. Leading scholars use critical case studies to shed light on new approaches used by international courts and experts to balance these two bodies of law. 

Divided into four thematic parts, chapters explore the protection of specific groups and actors during conflicts, including organised armed groups, armed non-state actors, and refugees, as well as using divergent methodological approaches to analyse the extra-territorial application of human rights treaties. This volume discusses the impact of human rights law on other fields of international law. Does international human rights law modify other fields of international law? Contributions focus on possible spillover effects of human rights on international economic or international criminal law. Does international human rights law have a streamlining effect on international law as a whole? This might be identified as a process of constitutionalisation. In this book, human rights can be understood as one of the core principles of international legal order and thus have an effect on the general law of treaties or on the settlement of disputes.

Although human rights law is a relatively young field of international law, its content and core values today are of major importance for the interpretation of international law as a whole. As we witness a redefinition of sovereignty as a responsibility of states towards the people and a shift to greater relevance of the individual in international law in general, it is a logical consequence that human rights have an impact on other areas of international law.

Internationale Organisationen sind zu wichtigen internationalen Akteuren geworden, die innerhalb der Völkerrechtsordnung agieren. Ihr Handeln beruht auf rechtlicher Grundlegung und bedarf rechtlicher Einhegung. Dies gilt um so eher, je mehr dieses Handeln in die Rechtsphäre von anderen Völkerrechtssubjekten und von Individuen einwirkt. Ausgehend von einer breit angelegten historischen Analyse entwickelt die Arbeit eine Kompetenzlehre internationaler Organisationen.

Im Jahr 1966 wurden mit dem "Internationalen Pakt über wirtschaftliche, soziale und kulturelle Rechte" und dem "Internationalen Pakt über bürgerliche und politische Rechte" zwei verbindliche völkerrechtliche Verträge zum Schutz der Menschenrechte abgeschlossen. Das 50-jährige Jubiläum dieser beiden Vertragswerke nahm das MenschenRechtsZentrum der Universität Potsdam (MRZ) auf einer Tagung im November 2016 zum Anlass, die heutige Bedeutung der Pakte in den Blick zu nehmen.Die Autoren des Sammelbandes zeichnen aktuelle Debatten nach, die die philosophische Begründung und das Verständnis der Menschenrechte herausfordern. Um Probleme in menschenrechtsfreundlichen Rechtsordnungen zu benennen und Verbesserungsvorschläge zu erarbeiten, untersuchen weitere Beiträge exemplarisch die Wirkung der beiden Menschenrechtspakte in der deutschen Rechtsordnung, insbesondere durch eine Analyse der Gerichtspraxis.Hiervon ausgehend suchen die Autoren Antworten auf Compliance-Defizite bei internationalen Menschenrechtsverträgen.
