Drawing together all of the legal issues associated with drafting, negotiating and litigating or arbitrating commercial agreements, International Commercial Contracts: Law and Practice provides a comprehensive reference work of all these disparate areas. The first part of the book sets out and analyses the substantive law that parties can choose to apply to contracts, as well as that which must be applied due to non-negotiable international law. This part includes coverage of contract, trade, insurance and financing law relevant to commercial contracts. There is also analysis and explanation of key specialist areas, including intellectual property, tax and competition law. The book includes a key section on dispute resolution setting out the various mechanisms available to contracting parties, addressing litigation, mediation, arbitration, and class actions. The final parts cover negotiation, drafting and ethical issues associated with contracts.

This book provides an insight into commercial relations between large economies and Small States, the benefits of regional integration, the role of Small States as financial centres as well as B2B and State to State dispute resolution involving Small States. Several contributions allow the reader to familiarise themselves with the general subject matter; others scrutinise the particular issues Small States face when confronted with an international dispute and discuss new and innovative solutions. These solutions range from inventive ideas to help economic growth to appropriate mechanisms of dispute resolution including inter-State dispute resolution and specific areas of arbitration such as tax arbitration. Researchers, policy advisors and practitioners will find a wealth of insights, information and practical ideas in this book.

Given the high rates of family violence in Samoa, this book aims to contribute to research and education to support its prevention and response. It adopts a predominantly legal perspective, examining the intersection of criminal law, international law, and Samoan customary law, while recognising the cultural, religious, and social context in which family violence occurs. It argues that effective responses must be founded in Samoan communities, led by Samoan people, and grounded in fa‘asamoa (the “Samoan way”). The publication incorporates a literature review and interviews with individuals working to address family violence in Samoa. One of its key findings is that community education is urgently needed to strengthen culturally, religiously, and legally informed approaches at village and family levels and to empower Samoan communities. The book examines the Samoan cultural and socio-legal context, the criminalisation of family violence under Samoan and international law, comparative approaches in other jurisdictions, existing prevention and response initiatives, and the innovative work of Samoa’s Family Violence Court. It assesses progress to date, identifies remaining challenges, and considers how culturally grounded responses can strengthen future efforts. Drawing on comparative experiences from three overseas jurisdictions, it explores lessons that may inform reforms while recognising that responses must be tailored to the Samoan context rather than transplanted from elsewhere. The book is intended for practitioners, service providers, policymakers, researchers, and others working to prevent and respond to family violence in Samoa, as well as readers interested in family violence law, legal reform, and culturally appropriate justice initiatives. While no single project can eliminate family violence, this publication seeks to contribute to ongoing efforts to reduce harm and support safer Samoan families and communities.

This book is a unique collection of high quality articles analysing legal issues with particular regard to small states. The small states of the world differ considerably in their geography, history, political structures, legal systems and wealth. Nevertheless, because of their size, small states face a set of common challenges including vulnerability to external economic impacts such as changing trade regimes and limited ability to diversify economic activity; limited public and private sector capacity, including the legal and judicial infrastructure; a need for regional co-operation; a vulnerability to environmental changes as well as a limited ability to engage with supranational bodies and the forces of globalisation. This is the first volume of an exciting and unique new series, The World of Small States. In this work, legal experts from small jurisdictions and those with a particular interest in legal issues facing small states explore inter alia ethics in small jurisdictions, legal education and the profession in small states, the challenges facing small states with mixed legal systems, the constitutional arrangements in small states, small states as tax havens, and intellectual property and competition law issues.

This book is dedicated to Professor Schlechtriem and his tremendous life time work on the United Nations Convention on the International Sale of Goods (CISG) and all past, present, and future participants of the Willem C Vis Moot for whom hopefully the book will be of some use. To have been asked to adopt Professor Peter Schlechtriem’s German text book Internationales UN-Kaufrecht (4 ed, Mohr Siebeck, Tübingen, 2007) for the English speaking student, academic, and practitioner and to work with Professor Schlechtriem on this edition has been a great honour. Unfortunately this book has been longer in the making than originally planned and more unfortunately still was not finished in time for Professor Schlechtriem to see its publishing. The aims of this book are more modest than other compendious treatments of the CISG. The main aim above all others has been to facilitate discussion on the use and application of the provisions of the CISG. As the CISG itself was the outcome of nearly a decade of debate between nations polarised in ideology, the importance of continuing discussion cannot be understated. This is especially true in regard to common law countries like Canada, Australia, and New Zealand which have all ratified the CISG many years ago but where its use and jurisprudence are rather underdeveloped.

All nation states, whether ancient or newly created, must examine their constitutional fundamentals to keep their constitutions relevant and dynamic. Constitutional change has greater legitimacy when the questions are debated before the people and accepted by them. Who are the peoples in this state? What role should they have in relation to the government? What rights should they have? Who should be Head of State? What is our constitutional relationship with other nation states? What is the influence of international law on our domestic system? What process should constitutional change follow? In this volume, scholars, practitioners, politicians, public officials, and young people explore these questions and others in relation to the New Zealand constitution and provide some thought-provoking answers. This book is recommended for anyone seeking insight into how a former British colony with bicultural foundations is making the transition to a multicultural society in an increasingly complex and globalised world.
