Indeed it is striking that more often than not, it was the texts of renowned writers that were dealt with by the courts, as for example Gustave Flaubert’s Madame Bovary and Charles Baudelaire’s Les Fleurs du Mal in France, James Joyce’s Ulysses and Henry Miller’s Tropic of Cancer in the US, D.H. Lawrence’s Lady Chatterley’s Lover in Great-Britain, up to the more recent trials on Klaus Mann’s Mephisto and Maxim Biller’s novel Esra in Germany.By bringing together international leading experts, Literary Trials represents the first step towards a systematic discussion of literary trials on a global scale. Beginning by first reassessing some of the most famous of these trials, it also analyses less well-known but significant literary trials. Special attention is paid to recent developments in the relationship between literature and judicature, pointing towards an increasing role for libel and defamation in the societal demarcation of what literature is, and is not, allowed to do.

Intention plays a complex role in human utterances. The interpretation of literary texts is a strong case in point: for about two hundred years there have been conflicting views about whether, and how much, authorial intention should matter when professional readers interpret literature. These debates grew increasingly fierce during the post-World War II period, the landmarks of which were the notions of intentional fallacy and the death of the author. Seventy-odd years later, there is still no consensus in sight. What has always been neglected in the debates around authorial intention, however, is a reflection on the historical dimension of the debate and how historically bound each of the theoretical positions in the debate were. This book focusses precisely on the historical dimension of authorial intention, providing a systematic historical reconstruction of the importance ascribed to it in literary texts from Classical Greece to the present day, and including a chapter on authorial intention in jurisdiction and legal interpretation from a historical perspective. The book reconstructs a typology of the most important concepts of intention in interpretation for diachronic and synchronic use. At the same time it offers insights from a field-theoretical perspective into how literary studies as a discipline works over time and how notions of intention and interpretation help create forms of literary knowledge.

One of the aims of the book is to shed more light on the notion Neue Sachlichkeit in its appearance in a variety of fields as painting, architecture, music, photography and literature, in order to get a clearer idea of its scope. Several contributions will do so by analysing the heterogeneity in the use of the term concerning its function in the fight for recognition in the art-fields around 1930 - in other words, Neue Sachlichkeit will be analysed as a positioning strategy. Especially its participation in the broader discourse on modernity, as well as its international and intermedial dimension will be highlighted, often using the historical avant-garde as point of reference. From this perspective, the present volume wants to be read as a plea for a differentiated description of the many shared aspects and some differences between the avant-garde and Neue Sachlichkeit.
