The continuum of exploitation that has historically defined the everyday of domestic work - exclusion from employment and social security standards and precarious migration status – has frequently been neglected. It is primarily the moments of crisis, incidents of human trafficking, slavery or forced labour, that have captured the attention of human rights law. Only recently has human rights law has begun to address the structured inequalities and exclusions that define the domain of domestic work.This book addresses the specific position of domestic workers in the context of evolving human rights norms. The book is targeted at academics and students working in the field of migration and asylum law. It will also be of interest to practitioners and to policy makers in Europe, as the first extended scholarly analysis of this field of Irish law. Many of the significant legislative, constitutional and jurisprudential changes that have occurred, have resulted from contested claims arising under EU, ECHR and comparative constitutional law. The book will interest scholars across these fields, and will become a key reference work for the legal profession and researchers in the rapidly expanding area of migration and asylum law. The book is likely to attract significant interest in North America, where debates on citizenship law in Ireland in particular have been followed closely, given the transnational judicial dialogue in Irish courts, referencing US case-law, and the close links between academics and the superior courts in both jurisdictions. Current scholarly work on citizenship law in Ireland has been widely cited in key texts by leading immigration law scholars in the US and Canada, for example.

In recent years, feminist theory has increasingly defined itself in opposition to universalism and to discourses of human rights. Rejecting the troubled legacies of Enlightenment thinking, feminists have questioned the very premises upon which the international human rights movement is based. Rather than abandoning human rights discourse, however, this book argues that feminism should reclaim the universal and reconstruct the theory and practice of human rights. Discourse ethics and its post-metaphysical defence of universalism is offered as a key to this process of reconstruction. The implications of discourse ethics and the possibility of reclaiming universalism are explored in the context of the reservations debate in international human rights law and further examined in debates on women's human rights arising in Ireland, India and Pakistan. Each of these states shares a common constitutional heritage and, in each, religious-cultural claims, intertwined with processes of nation-building, have constrained the pursuit of gender equality.Ultimately, this book argues in favour of a dual-track approach to cultural conflicts, combining legal regulation with an ongoing moral-political dialogue on the scope and content of human rights.
