Seeking to open paths for reconsidering the trade and development relationship at the WTO, this book takes into account both the heritage of the trade regime and its present dynamics. It argues that the institutional processes for creating and implementing trade rules at the WTO and the actual regulatory outcomes are inseparable. A consideration of the WTO''s development dimension must examine both jointly. It shows that the shortcomings of the Doha Development Round are in part due to a failure to assess trade rules as part of the legal processes and institutions that produced them. This book devotes significant analysis to the systemic impact of the WTO as an institution on developing and least developed members. From a pragmatic perspective, it provides a coherent and systematic analysis of the legal meaning, the implementation, and the adjudication of special and differential treatment rules for developing members. It then evaluates the different regulatory approaches to trade and development from a more theoretical perspective. The book finishes by presenting a range of proposals for a better balance between trade liberalization and the development needs of many WTO members.

Adopting an actors-focused approach, this Research Handbook engages with complex dynamics between states, people and businesses with respect to trade law and development. Sonia E. Rolland brings together scholarly and policy experts who articulate contemporary research on the linkages between trade, sustainability, food security, intellectual property, industrial policy and the digital economy, amongst many others. The contributing authors address trade law through an interdisciplinary lens, examining its political, economic and social contexts. Several chapters highlight challenges including sustainability and digitalization, as well as potential solutions for developing countries in the WTO dispute settlement system. The Research Handbook demonstrates the fiscal implications of trade rules and climate policymaking, featuring case studies from across Africa, the Americas and Asia to draw attention to international trade policies in the context of economic development. It also seeks to empower minority groups ranging from women and indigenous people to small and micro entrepreneurs, as well as investors from emerging countries with an equitable approach to trade relations. The Research Handbook on Trade Law and Development is an essential resource for scholars and students in international trade, international economic law and law and development. Its unique insights on alternative approaches to trade law and negotiations will greatly benefit international policymakers and business executives.

The post-war liberal economic order seems to be crumbling, placing the world at an inflection point. China has emerged as a major force, and other emerging economies seek to play a role in shaping world trade and investment law. Might they band together to mount a wholesale challenge to current rules and institutions? Emerging Powers in the International Economic Order argues that resistance from the Global South and the creation of China-led alternative spaces will have some impact, but no robust alternative vision will emerge. Significant legal innovations from the South depart from the mainstream neoliberal model, but these countries are driven by pragmatism and strategic self-interest and not a common ideological orientation, nor do they intend to fully dismantle the current ordering. In this book, Sonia E. Rolland and David M. Trubek predict a more pluralistic world, which is neither the continued hegemony of neoliberalism nor a full blown alternative to it.
