Infolge von Globalisierung und Europäisierung büßt der Nationalstaat an Regelungsmacht im Arbeitsrecht ein. Gleichzeitig verlagert sich Normsetzung auf transnationale private und hybride (staatlich-private) Akteurskonstellationen. In Europa gewinnen verschiedene Formen grenzüberschreitender kollektiver Verhandlung zwischen Arbeitgeber- und Arbeitnehmerseite – als Soziale Dialoge bezeichnet – an Bedeutung. Das Buch nimmt transnationale Regulierung in einem Feld in den Blick, das zu den Kernaufgaben des Sozialstaats zählt: dem Schutz vor Diskriminierung. Normbildungs- und Normdurchsetzungsprozesse Sozialer Dialoge werden mittels Dokumentenanalyse, Experteninterviews, vertiefenden Fallstudien und Diffusionsanalyse untersucht. Im Zentrum steht die Frage, ob Soziale Dialoge, die teilweise auf eine unklare Rechtslage verwiesen sind, stärkerer Verknüpfung mit (supra)staatlichen Rechts- und Durchsetzungsstrukturen bedürfen, um sozialstaatlichen Aufgaben entsprechende Ergebnisse zu erzielen.
