Document from the year 2008 in the subject Law - European and International Law, Intellectual Properties, , language: English, abstract: With the advent of Human Rights in international law, several core ideas of the traditional system of international law have been challenged, such as the principle of non-interference and state sovereignty, as well as the prohibition of the use of force, especially with the decision that massive human rights violations can form a threat to international peace and security to which the UN Security Council can respond with measures according to Chapter VII of the UN Charter.While at first sight a change of paradigm in international law, or in any legal system, is not negative per se, the rules which collide with a truly effective and universal protection of HR through international law are the very rules which form the foundation for international peace and security, the primary reason for the existence of international law. While international peace and security require the stability provided by the Westphalian system, they can at the same time be endangered by massive violations of human rights. On the other hand can Human Rights only be enjoyed in times of peace while the Westphalian system can limit the effective and universal enforcement of Human Rights in cases in which the UN Security Council has failed to take action under Chapter VII.This short book is an attempt at reconciling these needs which are at times direct against each other, at times interlinked ones with a special focus on massive violations of human rights which are not being addressed effectively by the UN Security Council. To this end, we will look at the Human Rights dimensions of international peace and security outlined above before we come to the core issue of the paper, the legality of the use of force for the protection of Human Rights in cases in which the UN Security Council fails to act, or, in other words, the question of in how far the need for universal respect for human rights can overrun the need for peace, given the links between both factors indicated above.

Document from the year 2008 in the subject Law - European and International Law, Intellectual Properties, Université Paris-Sorbonne (Paris IV) , language: English, abstract: About 5.4 million people have been killed in the wars in the Democratic Republic ofCongo (D.R.C.), the former Zaire. 45,000 die every month and hundreds of thousands ofwomen have been raped here in recent years. Wartime rapes are anything but new and havebeen employed not only to terrorize the population but also as weapon of genocide inRwanda, Bosnia and Darfur. The Eastern Congolese provinces of North and South Kivuhave been affected by particular gruesome acts of violence and thousands of victims sufferfrom rape-induced fistulae, ruptures of the walls which separate the victim''s vagina fromher rectum. According to UN staff and doctors in the region, all armed groups in theregion are involved in rapes and despite the 2002 Pretoria Accord which put an official endto the war, attacks and rapes continue to this very day. Many survivors are forced out oftheir homes and their families abandoned and left to fend for themselves. Therefore, apartfrom medical treatment and psychological counseling, there is a strong demand for justice.But due to the weak position of women in Congolese society, justice is much harder to getby than medical treatment. Although the Congolese Penal Code and Military Penal Codepenalize these crimes, the reaction by the Congolese government to the atrocities remainsinsufficient, making a solution based on Congolese criminal law unlikely. The practicalapplication of the D.R.C.''s domestic laws is found wanting and the law does not have thedeterrent effect which is required to prevent future atrocities, also due to the traditionalposition of women in Congolese society continues to be reflected in the law: According toArt. 448 of the D.R.C.''s family code, a married woman has to obtain her husband''spermission to bring a case to court – which provides a major obstacle on the road tojustice. This book deals with the multidimensional aspects of the problem, which rangefrom medicine and psychology to social issues and the quest for justice. In the latter partwe will examine not only the background by looking at relevant rules of InternationalHuman Rights Law and International Humanitarian Law but also look at legal responses tothese crimes both on a national level in the D.R.C. as well as on an international level andwith the question of how justice can be achieved for rape victims in a country ravaged bywar in which women continue to be second class citizens.

Al-ready today the pharmaceutical industry is a key employer in Europe. At the same time, the pharmaceutical industry is marked by a very ex-pensive research and development phase, which makes strong intellectual property rights crucial to ensure that research for new pharmaceuticals remains commercially interesting. But not only direct threats to intellectual property rights, such as the production of generic phar-maceuticals or the sale of counterfeit pharmaceuticals, pose a threat to those pharmaceutical companies which heavily invest in research for the development of new products: different prices for identical pharmaceuticals in different member states of the European Community make it economically interesting to buy pharmaceuticals in one member state and sell them abroad. It might even be cheaper to sell reimported pharmaceuticals in the country of origin. This possibility opens a whole new market for reimporters which cuts directly into the profit of the producers. In this thesis we will look at different issues surrounding intellectual property rights in the European pharmaceutical sector by investigating the jurisprudence of the European Court of Justice and the Court of First Instance.

Scientific Essay from the year 2011 in the subject Law - Miscellaneous, University of Gottingen, language: English, abstract: The child abuse scandal has rocked the Catholic church and has triggered a strong response by the church leadership, first and foremost by Pope Benedict XVI. On 13 September 2011, a case was brought against the pope and several other high ranking church officials at the International Criminal Court in The Hague for alleg-edly "e;enabling"e; child abuse to go unpunished. It has been claimed that this would amount to crimes against humanity. In this short text it will be shown that there has been no "e;enabling"e; on the part of the Holy Father, that there is no basis for a criminal responsibility and that such obviously unfounded claims can actually have serious impacts on the proper functioning of international judicial organs. The con-clusion is reached that the International Criminal Court is the wrong place to reg-ister grievances in this context and that the justice which all victims deserve will not be achieved in this manner. This article is part one in a new series on European and International Human Rights Law.

In this essay, we will see that the situation in Germany, the Netherlands, Belgium, the United Kingdom and Turkey differs significantly from the situation in the other states which are parties to the European Convention on Human Rights (ECHR). It is the aim of this text to provide lawyers in those countries with a short guidance as to how to approach both the European Court of Human Rights but also - and even more importantly - domestic courts with regard to this issue. In particular the high caseload of immigation law courts as well as a lack of knowledge about the Convention make it necessary for practising lawyers to be informed about the rights of their clients. This article is designed as a practical guide and first reference paper for lawyers to assess the prospect of cases dealing with rights of migrants. The first part of this article will deal with ratione loci of the ECHR and its fundamental jurisprudence focusing on the special issues appearing in the context of migration law. In the second part the right to a fair trial under Art. 6 ECHR will be addressed including recent rulings of the Court and fundamental questions regarding the administrative procedure of granting asylum. The final part will be dealing with the rights of asylum seekers in countries which did not ratify Protocol 7 and the consequences this fact entails.

Still closely related to the fundamentals on which law is built, such as philosophy, biolaw has evolved into a truly legal discipline. At the same time has it been recognized that biolaw has multiple sources and the recent emergence of the discipline makes these sources still relatively visible. This visibility might limit the acceptance of biolaw and in this article it will be attempted to pay attention to some of the issues which follow from the fact that biolaw is based on multiple sources. Particular attention will be given to one aspect which might be most controversial from a political perspective: the continued role of religion - and in particular Christian religion - in shaping thinking about biolaw also in secular societies.

Scientific Essay from the year 2015 in the subject Law - European and International Law, Intellectual Properties, grade: -, , language: English, abstract: Domestic violence against women remains a major problem which often is off the radar screen of public authorities as dismissive attitudes towards women persist among those working for local security forces (which often are male-dominated) and - for a wide range of reasons, including in particular fear of further violence against the victim or children - many cases are not reported. The risk of underreporting makes it necessary for authorities to be particularly vigilant and sensitive to situations which are threatening for women. In this research article it will be shown that the European Convention on Human Rights can provide an effective legal tool to ensure that the authorities take this positive human rights obligation seriously.

This is particularly the case in Germany, where institutions related to Christian groups, including the united evangelical regional churches and the Catholic church are the second most important employer after the public sector. At the same time is there a sense of increased secularization. This can lead to situations in which employees, while willingly employed by a religiously motivated organization, openly defy key rules of this religious group, e. g. when it comes to issues such as divorce or homosexuality. In the last years, a number of cases have made it through the court system in Germany and eventually to the European Court of Human Rights. By looking at some of these cases and the wider case law of that Court, this article is aimed at providing the reader with an overview over the topic but also with an answer to the question how the European Convention on Human Rights, which allows for a wide range of legal models concerning the relationship between the state and organized religions.

In 2014 in parts of Norway a rapid increase in radioactivity was reported in reindeer meat as a result of the consumption of specific mushrooms which store large amounts of cesium-137. In this article the question will be asked if reindeer herders can have a claim for compensation under the European Convention on Human Rights.

However, they are neither. While being different from the majority population, and all too often having been (and often continuing to be) oppressed, in recent years a change has become visible in the attitude towards indigenous peoples. Indigenous peoples are first of all that, peoples - with their own cultures and histories. It is because of their particular lifestyle and relationship with an other culture, that they are seen as different. However, more and more indigenous peoples are taken more seriously in their own right. In this essay the research of indigenous legal norms by outsiders is investigated from the perspective of indigenous rights. Based on a premise of respect for indigenous norms, issues such as benefit sharing and access to research results are discussed, as well as research ethics.

Essay from the year 2015 in the subject Law - European and International Law, Intellectual Properties, , language: English, abstract: This short essay introduces the reader to the aspects of the United Nations Convention on the Law of the Sea, often simply referred to as the Law of the Sea Convention (LOSC) which are often overlooked but which play a crucial role already today and which are bound to become more important in the future. Marine scientific research is no longer merely of academic interest. Oil, gas, fish and in the near future also natural resources at the sea bed are important economic factors. In particular in the Arctic Ocean, which is becoming more accessible due to climate change and the fast decline of the sea ice cover, competing claims to the sea provide new challenges. These conflicts include the territorial dispute between Denmark (which despite Greenland s increased autonomy retains control over the island s foreign affairs) and Canada over Hans Island, At the time the 1982 Convention was drafted, the idea that commercial mining of the Deep Sea Bed was just around the corner. While the technological development immediately after the adoption of the Law of the Sea Convention took longer than had been thought initially, advances in recent years have made deep sea mining a more realistic possibility. Indeed, several claims have been staked around the world. A distinction has to be made between claims to the Continental Shelf (which is not to be confused with the Deep Sea Bed) as an extension of the sovereignty of the state over the land on one hand and usage rights in parts of the Deep Sea Bed on the other.

Scientific Study from the year 2015 in the subject Law - European and International Law, Intellectual Properties, , language: English, abstract: This article examines the legality of tactical nuclear weapons under International Humanitarian Law. Additionally, the ideas behind the development of tactical nuclear weapons as well as their historical background during the Cold War and after 9/11 are examined. Tactical (or 'small') nuclear weapons have been developed during the Cold War and had been deployed e.g. to West Germany for possible use on the battlefield in the event of a Soviet invasion of Western Europe. After the end of the Cold War, the dangerous idea that nuclear weapons could be used on the battlefield without triggering a global thermonuclear conflict has remained relevant. It has been discussed e.g. in the context of the threat posed by the Iranian nuclear weapons program as one possible way to destroy hardened or underground targets. In this paper the issue of tactical nuclear weapons is approached from the perspective of International Humanitarian Law, the set of rules which govern the conduct of armed forces in conflict.

Scientific Essay from the year 2015 in the subject Law - European and International Law, Intellectual Properties, , language: English, abstract: The European Convention on Human Rights (ECHR) covers 47 states with very different legal cultures and political histories. Written from the perspective of the situation in Malta, this short essay looks at the question of the limits to the negative dimension of Article 12 ECHR. This can lead to surprising results, which become less surprising if the historical background of the drafting of the ECHR is taken into account. The text also shows a way to avoid some of the consequences of the narrow approach employed by the drafters - without abandoning the fundamental ideas behind the Convention.
