However, multiracial people still face discrimination. Many legal scholars hold that this is distinct from the discrimination faced by people of other races, and traditional civil rights laws built on a strict black/white binary need to be reformed to account for cases of discrimination against those identifying as mixed-race. El presente libro se encuentra estructurado en tres partes bien diferenciadas. En la primera, se examina la relación que existe entre el constitucionalismo latinoamericano y el estadounidense. En particular, se examina la idea ampliamente difundida de que Latinoamérica es un mero espacio de reproducción y difusión de la producción constitucional estadounidense (o de algunos países de Europa continental) y que Estados Unidos es un contexto de producción de conocimiento jurídico universalizable y exportable al mundo entero. En la segunda parte del libro, se examina críticamente la experiencia que ha tenido Latinoamérica tanto con el constitucionalismo liberal como con el radical durante los últimos 25 años. Por un lado, se analiza la experiencia de países como Colombia, México y Argentina con el modelo constitucional liberal y, por el otro, se hace un balance de las experiencias ecuatoriana, boliviana y venezolana con lo que comúnmente se conoce como el socialismo del siglo XXI o el constitucionalismo radical.
