Am 1. Januar 2020 traten das Finanzdienstleistungsgesetz (FIDLEG) und das Finanzinstitutsgesetz (FINIG) sowie die dazugehörenden Verordnungen über die Finanzdienstleistungen (FIDLEV) und die Finanzinstitute (FINIV) in Kraft. Diese beiden Gesetze bilden den Kern einer umfassenden Revision des schweizerischen Finanzmarktrechts. Das FIDLEG legt die Anforderungen für das Erbringen von Finanzdienstleistungen fest, unter anderem durch aufsichtsrechtliche Verhaltensregeln und organisatorische Vorschriften. Unter gewissen Voraussetzungen müssen sich Kundenberaterinnen und Kundenberater im neu zu schaffenden Beraterregister registrieren lassen. Zudem führt das FIDLEG für Effekten, die öffentlich angeboten oder an einem Handelsplatz gehandelt werden, vereinheitlichte Prospektanforderungen ein. Damit verbunden ist auch die erstmalig eingeführte Prüfung des Prospektes durch eine Prüfstelle. Bei Angeboten von Finanzinstrumenten an Privatkundinnen und Privatkunden ist unter Umständen ein Basisinformationsblatt zu erstellen. Ausserdem wird von Finanzdienstleistern neu verlangt, dass sie sich einer Ombudsstelle anschliessen müssen. Im FINIG werden neu die Bewilligungen für Finanzinstitute zusammengefasst. Als grösste Neuerung fallen mit dem FINIG neu Vermögensverwalter sowie Trustees unter die Bewilligungspflicht. Das vorliegende Buch bietet einen Überblick über die wichtigsten Aspekte des FIDLEG und des FINIG, unter Berücksichtigung der im November 2019 veröffentlichten definitiven Verordnungstexte.
