Reshaping Juvenile Justice examines reforms in New South Wales under the Young Offenders Act 1997. The Act institutionalises a fresh approach to juvenile justice as one that regulates police discretion at the gate-keeping level, emphasises diversion as a principle, introduces restorative conferencing as an intermediate intervention, and relegates the use of courts to the last resort. The enactment of the Young Offenders Act followed years of experimentation with various models of police cautioning and diversion. The Act is unique in its focus on community, victim and family participation, in the limits it places on the exercise of police discretion, and in the provisions made for children's access to legal advice. The reform is also exceptional in that it was implemented through an unusual mixture of cross-government and community co-operation. An independent agency, the Youth Justice Conferencing Directorate, was established to manage and administer youth justice conferences. Conference convenors are recruited from individuals who live and work in the local communities. As an innovative social experiment, policymakers and researchers will watch the impact of the Act both nationally and internationally. Reshaping Juvenile Justice brings together the most up-to-date research evidence and analysis of the Young Offenders Act. It details the history of the Acts development and implementation. It describes the working of the Act and evaluates its effectiveness and impact on young offenders, victims, and juvenile crime. In discussing the strengths and weaknesses of the Act and in identifying the critical success factors and barriers to implementation, the monograph lays the groundwork for future debates on juvenile justice in Australia.

Police interrogation attracts debate and controversy around the world. Audio-visual recording is widely regarded as a panacea for problems in police questioning of suspects. Interrogating Images presents the first empirical study of the routine use of audio-visual recording anywhere in the world, focusing on New South Wales, Australia where such recording has been required for more than a decade. Its introduction is set in a historical account of disputes and concerns about police questioning of suspects. There is a detailed study of the participants in the interrogation process. Various styles of police interviewing are identified, showing out the nature and purpose of interrogation are inaccurate. A chapter assesses the impact in NSW of investigative interviewing, a questioning style very different from that used in the USA. The penultimate chapter examines the experiences and perceptions of criminal justice professionals judges, defence lawyers, prosecutors, and police. Interrogating Images concludes by pointing to some dangers of misusing audio-visual recording. If the complete questioning process is not recorded, confessions may be rehearsed and unreliable. A second danger is the misreading of images, particularly by those who overestimate their ability to identify deception from a suspect's body language. Audio-visual recording can be a useful tool, but it must be one part of a broader process of effectively regulating investigative practices. Interrogating Images is informative and thought provoking reading for lawyers, police investigators, academic researchers, policy-makers, legislators, students and those with an interest in police interrogation and its implications for criminal justice processes.

29 October 2007 marks twenty years since the death of five prisoners in a riot and fire in the infamous Jika Jika High-Security Unit. This book resurrects these events and invites us to learn urgent lessons in our current age of supermax and privatised prisons, detention of asylum seekers and the controversial use of indefinite detention under the banner of a 'war on terror'. Imprisoning Resistance provides an experiential account of life and death in the controversial Pentridge Prison Jika Jika High-Security Unit in Victoria during the 1980s. One of Australia's first hi-tech supermax prisons, Jika Jika was designed to house and manage the system's 'worst of the worst' prisoners. Several years of deaths in custody, multiple escapes, assaults, murders, prisoner campaigns and protests, hunger strikes and allegations of prison staff brutality escalated in 1987 to a dramatic protest fire that resulted in the deaths of five prisoners. The prison was closed and a series of inquiries were commissioned. Bree Carlton revisits this uncomfortable past and reconstructs events leading up to and surrounding the fire and deaths, while critically analysing official responses to the discreditable episodes, crises and deaths that plagued Jika Jika.

Conflict of interest allegations have become a prominent part of the landscape of political and public sector ethics in Australia and overseas. The arena of policing has not been immune from this problem and this book is based on unique and unfettered access to ten years of internal investigation files held by Victoria Police. Through detailed analysis of actual complaint cases it gives the reader a comprehensive map by which to chart the particular kinds of interests involved, the nature of conflicts with official police duties, and the particular contexts from which conflicts of interest emerge. The book examines conflicts of interest across the private and public realm of the everyday lives of police officers. The author outlines how the problem of conflict of interest is an important aspect of police ethics, arguing that recognition of, and accountability for, conflict of interest may be a significant element in preventing upstream police misconduct and corruption. Conflict of Interest in Policing seeks to provide a conceptual and practical understanding of how integrity and trust must be integrated into the profession of policing through processes of active responsibility, rather than more traditional passive obedience to prescriptive rules.

On the infamous afternoon of Sunday 11 December 2005, a crowd ofabout 5000, mostly white, English-speaking background young men, wenton a rampage at Sydney's Cronulla beach attacking anyone of MiddleEastern appearance. The day had begun as a protest against what manysaw as the unacceptable behaviour of some young men following a scufflebetween off-duty lifesavers and a group of Lebanese men. Such incidentsare not uncommon, yet rarely do they lead to large-scale, ethnicallymotivated violence in which people wrap themselves in the Australianflag. Many Australians, used to seeing racial violence in otherparts of the world, were shell-shocked. Yet the causes and consequencesof the riots and the revenge attacks that ensued are still beingdebated. Did the riots reveal the racist underbelly of Australiansociety? Did they demonstrate the failure of the multiculturalexperiment of the last 30 years? Were they yet another example of thecontemporary problems of youthful masculinities? Were we seeing theresurgence of an ugly nationalism, spread by populist media? In this provocative and insightful collection of essays, theauthors examine these and other issues in the first major criticalassessment of this significant moment in Australian history.

Meticulously research and elegantly written, Border Crimes argues that Australia's treatment of asylum seekers as illegal immigrants should itself be regarded as criminal as state crime. Mike Grewcock marshals the evidence irrefutably; after reading his account, boat people will never again appear as suspected illegal entrants. Professor Scott Poynting, Manchester Metropolitan University In this powerful and compelling book, Mike Grewcock eloquently exposes the organised criminal abuses and violence perpetrated by states against one of the worlds most vulnerable populations. Through the lens of a state crime framework and with conceptual rigour he traces the political and historical antecedents of Australia's shameful asylum policy and practice. Refreshingly this book is not only about unconscionable crimes committed by states it also engages with resistance and locates the possibility of social justice firmly within the domain of civil society. Once upon a time police were not allowed to unionise. Now they are among the most highly unionised of workers. When Police Unioniseshows how that happened in Australia. More than that however - this book is a study of the contemporary politics of policing, about the generation of law and order politics in Australia since the 1960s, and about the implications of these developments for the way criminal justice systems work. The highly publicised intervention of the Queensland Police Union in the 1996 Mundingburra by-election is the starting point for a study of the longer history of political activity of police. Set against an international context of increasing police militancy, the book examines the very early unionisation of police in Australia, the turmoil of police industrial relations during the inter-war decades, the combative approach ofpolice commissioners like Blamey in Victoria and MacKay in New South Wales, the optimistic post-war alliance with the Australian labour movement, its collapse in the 1960s and the subsequent emergence of a more autonomous, belligerent and ambitious police union culture. This is a critical appraisal of the politics of law and order in Australia, seen from the perspective of police in their role as workers and employees. The book helps us understand why police have the voice they do in public debates about crime, justice and policing - and why their impact is nevertheless limited by the play of politics in contemporary Australia.

In 1989 New South Wales became the first Australian state to pass legislation outlawing racial vilification. By 2001 the Commonwealth and the majority of Australian states and territories had followed suit, suggesting a broadly held view that racism was a sufficiently serious problem in Australian society to warrant the imposition of legislative restrictions and sanctions on conduct which generated ill-feeling against particular racial or ethnic groups. And yet, throughout this period the legal regulation of racial vilification has been controversial, with each new legislative reform initiative prompting heated debate. Regulating Racism provides a comprehensive examination of the history and current operation of federal, state and territorial racial vilification laws in Australia. Based on detailed analysis of relevant reports, legislation, parliamentary debates, statistical data, and judicial and quasi-judicial decisions, it reviews the range of approaches to the legal regulation of racial vilification which have been adopted in this country, including the creation of: criminal offences; statutory torts; and grounds of human rights complaint. The book addresses a number of key questions about the origins and operation of racial vilification laws. Why were different legislative models chosen? What are the implications of those choices for victims of racial vilification? What impact have free speech 'rights' and values had on the approach which Australian law-makers have adopted towards the regulation of racial vilification? How have racial vilification laws been applied and interpreted by human rights agencies, prosecuting authorities, tribunals and courts? Regulating Racism evaluates the strengths and weaknesses of the various approaches to the legal regulation of racial vilification which have been utilised to date in Australia. It makes an important contribution to our understanding of the role and limits of racial vilification laws in a democratic multicultural society.
