Studienarbeit aus dem Jahr 2020 im Fachbereich Jura - Steuerrecht, Note: 14 Punkte, Universitat Regensburg, Sprache: Deutsch, Abstract: Diese Arbeit behandelt die Grundsteuer und geht dabei umfassend auf das bisherige Grundsteuersystem, geschichtliche Hintergrunde, das Urteil des BVerfG, welches die Grundsteuerreform zur Folge hatte, sowie mogliche Reformmodelle und das beschlossene Reformmodell ein. Dabei werden verschiedene kritische und verfassungsrechtlich bedenkliche Aspekte miteinbezogen und beleuchtet. Ebenso enthalten ist ein umfassendes Literaturverzeichnis, das bei der eigenen Quellensuche helfen kann. Die Grundsteuer ist eine der altesten Steuern uberhaupt und spielt auch heute noch eine bedeutende Rolle fur die Finanzausstattung der Kommunen: Sie besteuert den Besitz von Grundstucken und Gebauden und steht gem. Artikel 106 VI GG den Gemeinden zu, in deren Hoheitsgebiet diese liegen. Mit zuletzt ca. 14 Mrd. Euro Jahresaufkommen bundesweit stellt sie eine stabile und unverzichtbare Einnahmequelle fur die Gemeinden dar. Kritische Stimmen sehen die Grundsteuer jedoch als eklatante Verletzung des Leistungsfahigkeitsprinzips der Besteuerung und sind der Ansicht, sie genuge auch dem Aquivalenzprinzip nicht. Als einzige Steuer, die zur Berechnung der Bemessungsgrundlage noch immer auf die vollig veralteten Einheitswerte Bezug nimmt, wurde die Grundsteuer hinsichtlich ihrer Verfassungsma igkeit wegen eines moglichen Versto es gegen das Gleichheitsgebot aus Art. 3 I GG bereits seit Jahrzehnten kritisch betrachtet. So war es nur eine Frage der Zeit, bis sich auch das BVerfG mit dieser Problematik auseinanderzusetzen hatte, was Ende 2014 dann auch der Fall war. Mit Urteil vom 10.04.2018 erklarte das BVerfG das alte Grundsteuermodell fur verfassungswidrig und forderte eine Neuregelung bis Ende 2019. Am 08.11.2019 wurde daher nach vielen Diskussionen um potentielle Reformmodelle die wohl wichtigste Steuerreform des vergangenen Jahres vom Bundesrat verabschiedet: die Erneuerung des Grundsteuermodells.
