The second Yearbook of the Central East European Forum of Young Legal, Political and Social Theorists aims at reassessing some major legacies of jurisprudence and political philosophy, thereby celebrating one hundred years from the publication of the first important theoretical account of Hans Kelsen – Hauptprobleme der Staatsrechtslehre; the fifty-years anniversary of one of the most important contemporary books in legal theory – Herbert Hart’s The Concept of Law; as well as the forty-years heritage of the most influential 20th century account of justice – John Rawls’s A Theory of Justice. On this occasion fourteen scholars from Eastern and Central Europe gave their accounts and interpretations of jurisprudential and political philosophical problems that persist or emerge anew in contemporary debates.

Over the last two decades scholars and citizens in Central and Eastern Europe had more than enough opportunity to realise that neither democracy nor the rule of law can be taken for granted. Such a realisation also means that if they want to think and speak clearly about or take a stand for their political and legal ideals, they need to reflect on them constantly, and conceptualise them in novel ways, by questioning entrenched lines of argument and problematising established patterns of thought. The contributors of this volume discuss a wide range of subjects from jurisprudential methodology and legal reasoning through democracy and constitutional courts to rights and criminal justice, raising questions and suggesting new ideas on «The Rule of Law and the Challenges to Jurisprudence» in Central and Eastern Europe and beyond.

This Yearbook of the Central and Eastern European Forum of Young Legal, Political and Social Theorists is devoted to the analysis of the consequences of the Central and Eastern European transition. The volume focuses on understanding the constantly evolving process of democratization. Following the collapse of the Soviet Union democratic transitions took place all over this region and the new democracies had different shapes. All states, however, wished to become a western-type democracy. The authors evaluate the ongoing struggle in the region to understand and to make others understand the peculiarities of these seemingly western-type, but somewhat different democratic regimes.
