    Beskrivning

Now in its second edition, William Schabas's leading article-by-article commentary on the European Convention of Human Rights is a clear and authoritative guide to every part of the Convention. With expert analysis on the substance of the rights, the workings of the European Court of Human Rights, and the enforcement of the Court's judgments, this commentary serves as a comprehensive entry point to the Convention system.A separate chapter is devoted to each distinct provision or article of the Convention, as well as to Protocols 1, 4, 6, 7, 12, 13, and 16. Each chapter includes an introduction situating the provision within the broader context of international human rights law; an account of the drafting history or preparatory work; detailed analysis of interpretation and key legal issues, with extensive reference to the jurisprudence of the Court and the former European Commission on Human Rights; and a selective bibliography. This new edition has been fully updated to reflect a decade of case law developments since the publication of the first edition. It examines major legal developments arising from the entry into force of Protocols 15 and 16, assessing their impact on the Convention system. Emerging and evolving areas of the Court's case law are considered, including artificial intelligence regulation, environmental protection, and the Convention's application in armed conflict and international criminal justice. Through a thorough review of the ECHR, this commentary is both exhaustive and concise. It is an accessible resource that is ideal for lawyers, students, policymakers, and others with an interest in the world's most successful human rights regime.

    Recensioner i media

Review from previous edition The Commentary is...among the finest published works on the Convention. It is, as one would expect, written with the erudition and authority of someone whose entire professional life has been closely associated with the international protection of human rights and with the Convention system. It is also a very well-structured work and the discussion of each Article of the Convention, both substantive and procedural, is prefaced with an invaluable introductory comment and a note on the drafting of the provision... More than that it is a pleasure to read... I welcome the Commentary without reservation and congratulate Professor Schabas very warmly for a work which will I predict swiftly become not only a leading work on the Convention system but an indispensable resource for all interested in what he calls one of the greatest stories of success in the modern protection of human rights.
