Beskrivning
Social media platforms have become the most consequential governors of public speech in human history, deciding what billions of people can say, see, and share across every democracy on earth. Yet they do so without electoral authorization, consistent rules, or democratic accountability. When platforms act, they are accused of censorship. When they refrain, they are accused of negligence. This book argues that this dual dissatisfaction is not a paradox but a symptom: the surface manifestation of three structural gaps that together make the legitimate governance of online speech systematically difficult to achieve.A governance gap separates what citizens across democracies expect platforms to do from what platforms are structurally incentivized or willing to deliver. A values gap arises from deep and irreducible disagreement - within and across democratic publics - about how to balance expressive freedom against protection from harm. A legitimacy gap reflects the absence of the foundations on which political authority normally rests: citizens do not accept platform governance because they trust platform companies, but because they perceive moderation decisions as procedurally fair and politically impartial. Yet across all ten countries, majorities believe that this condition is not being met.Drawing on comparative constitutional analysis of ten democracies, original cross-national survey data from over 13,000 respondents, and survey experiments with nationally representative samples, the book examines how ordinary citizens evaluate harmful speech, where they draw the line between protection and censorship, and how perceived governance failures shape their responses. It shows that perceptions of procedural fairness are the primary determinant of whether citizens accept moderation decisions, and that disagreements over content moderation are rooted less in partisan identity than in a fundamental normative trade-off between expressive liberty and protection from harm.Platforms and Freedom of Speech traces how liberty-centered and dignity-centered constitutional traditions structure state regulation, platform policy, and citizen attitudes in interconnected ways, and how these tensions intensify under conditions of concentrated private ownership and growing geopolitical pressure. It concludes that platform governance is not a problem awaiting a technical fix, but a condition of permanent misalignment requiring new forms of democratic accountability over the architecture of public communication.
