This book discusses the main legal questions raised by free and open source software (FOSS) licenses and other alternative license models, such as Creative Commons. The legal questions raised by FOSS and other alternative licenses have been the subject of an intense international debate among legal scholars and practising lawyers in the last years. Courts in different jurisdictions have confirmed that the core features of FOSS licenses are compliant with the respective applicable laws and thus enforceable in the respective jurisdictions. What is still missing so far is an in-depth comparative analysis of the legal issues raised by FOSS, Creative Commons and other alternative license on a worldwide scale. This book presents a general report on FOSS licenses and alternative license models to establish common ground and enable comparison between jurisdictions. The general report is followed by 24 national reports covering the world's most important IT-markets. General and national reports use the same structure to facilitate the comparison. The book shows that despite the differences in their origins, all FOSS projects use detailed licenses for the organisation of their communities. It also shows the differences in the proofing of these licenses by courts in some jurisdictions and the tailor-made provisions established by some legislators to solve the legal issues raised by the license model.

Der allgemeine Rechtsgrundsatz ( general principle, principe général) ist als Normtypus von hervorgehobener Bedeutung für das europäische Privatrecht. Zum einen greift der Europäische Gerichtshof seit den 1950er Jahren regelmäßig auf allgemeine Rechtsgrundsätze (oder "Prinzipien") zurück, um das nach wie vor lückenhafte Gemeinschaftsrecht zu ergänzen und auszulegen. Zum anderen arbeiten mehrere Wissenschaftsprojekte an der Sammlung rechtsvergleichend ermittelter " Principles ". Die EuGH-Rechtsprechung und die Arbeit der Wissenschaftlergruppen stellen dabei nur einen Ausschnitt des Gesamtphänomens dar. Rechtsgrundsätze erfüllen auch innerhalb der nationalen Systeme und im Einheitsrecht zentrale Funktionen bei der Rechtsfindung. Axel Metzger entwickelt im Grundlagenteil des vorliegenden Buches eine einheitliche Terminologie und Typologie der allgemeinen Rechtsgrundsätze und beleuchtet die erkenntnistheoretischen Grundlagen. Es zeigt sich, dass Prinzipien auf einem Schluss von besonderen Rechtsregeln auf einen "allgemeinen" Grundsatz basieren. Die Anforderungen an induktive Schlussverfahren können deswegen für die Untersuchung fruchtbar gemacht. Den Schwerpunkt der Untersuchung bildet die Behandlung der verschiedenen Ebenen des europäischen Privatrechts (Recht der Mitgliedstaaten, Gemeinschaftsrecht, Einheitsrecht, lex mercatoria), für welche der Autor jeweils die praktische Bedeutung von Rechtsgrundsätzen, die Methode ihrer Herleitung, die Funktionen sowie die Frage der rechtlichen Geltung analysiert. Zum Vergleich zieht er das Recht der Vereinigten Staaten heran.

Der Rechtsschutz von Pflanzenzüchtungen ist in den letzten Jahren erheblich in Bewegung geraten. Patente auf biotechnologische Erfindungen überlagern zunehmend die traditionell für Pflanzenzüchtungen vorgesehenen Sortenschutzrechte. Zugleich entwickelt sich die Zulassung von landwirtschaftlich genutzten Pflanzen nach dem Saatgutrecht zu einem rechtspolitischen Konfliktfeld. Die vorliegenden Beiträge beleuchten den agrarrechtlichen Regelungsrahmen, zeigen die aktuellen Trends in der universitären und kommerziellen Pflanzenzüchtung und behandeln die rechtspolitisch kontroversen Fragen der Überlagerung von Sortenschutz-, Patent- und Saatgutrecht. Ein besonderer Schwerpunkt liegt bei den Voraussetzungen und Grenzen des Nachbaurechts von Landwirten.
