Human Dignity, Judicial Reasoning, and the Law
Comparative Perspectives on a Key Constitutional Concept

This volume explores how national and international human rights courts interpret and apply human dignity. The book tracks the increasing deployment of the concept of human dignity within courts in recent decades. It identifies how human-dignity-based arguments have expanded to cover larger sets of cases: from the right to life or the right to integrity or anti-discrimination, the concept has surfaced in disputes about political and social rights and rule of law requirements, such as equality or legal certainty. The core message of the book is that judges understand, interpret, and apply human dignity differently. An inflation in the judicial recourse to human dignity can saturate the legal environment, depriving the concepts as well as human-rights-based narratives of salience, and threaten the predictability of court decisions. The book will appeal to philosophers of law, constitutional theorists and lawyers, legal comparativists, and international law specialists. While being dedicated specifically to human dignity jurisprudence, the book touches on many aspects of judiciary and as such will also be of interest to researchers studying legal reasoning, interpretation and application of the law and courts, as well as social philosophers, political scientists, and sociologists of law, politics, and religion.

New Perspectives on Human Dignity in Asia
Cross-Cultural Interpretations and Dialogue

This volume examines the concept of human dignity from uniquely Asian perspectives. As the Universal Declaration of Human Rights (UDHR) celebrates its 75th anniversary, human dignity is more consequential than ever, yet it is not understood in the same way in every nation or by every culture. Here, human dignity is approached from a number of distinctive viewpoints: its relation to religious freedom in maturing pluralist democracies, its foundation in ancient Eastern philosophy, its pursuit by liberation movements, and its alignment with Buddhism, Islam, and less familiar Indigenous religions. The authors, from various Asian countries, bring extensive scholarship and experience to bear on the project of expanding the idea of human dignity. They present a range of perspectives, having roots as they do in states with distinct religious and cultural traditions that, following the Second World War, have evolved toward constitutional democracies, as well as states where social and legislative developments related to human dignity have been influenced by more collectivist ideologies. The collection will be of interest to philosophers of law, constitutional and human rights theorists and lawyers, political historians, international law specialists and ethicists, and those interested in interfaith dialogue and multifaith engagement.

Freedom of Religion or Belief
Creating the Constitutional Space for Fundamental Freedoms

Using the metaphor of 'constitutional space', this thought-provoking book describes the confluence and convergence of powers in a constitutional system, comprised of the principled exercise of the legislative, executive and judicial powers of constitutional government. The book asserts that when governance is guided by principle, convergence creates greater space for all human rights and fundamental freedoms; both community and individuals thrive. Conversely when any right or freedom is given precedence over any other for reasons of political expediency, this results in the loss or diminution of human rights and fundamental freedoms. Addressing the issues surrounding the freedom of religion or belief, this timely book explores the dimensions of constitutional space and the content of this freedom, as well as comparative approaches to defining and protecting this freedom.Freedom of Religion or Belief will be a key resource for academics working in the fields of law and religion, law and society and human rights law. It will also appeal to practitioners and policy-makers working on the issue of religious freedom.Contributors include: P.T. Babie, R. Barker, A.P. Bhanu, A. Deagon, C. Evans, J. Forrester, N.
