Is academic freedom threatened? The book examines current challenges to academic freedom in Europe, focusing mainly on Italy and Germany. The cases discussed demonstrate that research and teaching are under pressure in European democracies: in Hungary and Poland due to political constraints, in other countries due to societal expectations. Considering different interrelated aspects, the four parts of the book explore many real and potential threats to universities, scientific institutions and researchers, ranging from the European dimension of freedom of the arts and sciences to comparative analysis of emerging challenges to academic freedom against the backdrop of the COVID-19 pandemic. They highlight threats to university autonomy from the economic orientation of university governance, which emphasizes efficiency, competition, and external evaluation, and from new rules concerning trigger warnings, speech restrictions, and ethics commissions. Detailed study of these complex threats is intended to stimulate scholarly reflection and elicit serious discussion at European and national level. The volume contributes to the search for a new role of universities and scientific institutions and is addressed to academics and political stakeholders.

Universitas semper reformanda est: Die Entwicklung einer Institution, welche die abendländische Kultur entscheidend mitgeprägt hat, wird anhand von drei europäischen Fallbeispielen (Deutschland, Österreich und Italien) dargelegt. Cristina Fraenkel-Haeberle untersucht dabei die sich abzeichnenden Internationalisierungsprozesse sowie die Mehrebenenstruktur des Hochschulwesens, das von der globalen Dimension bis hin zur Landes- bzw. Regionalebene reicht. Nach einer Schilderung der mittelalterlichen Entstehung der universitas als tradierte europäische Institution beleuchtet sie das immerwährende Spannungsverhältnis zwischen universitärer Selbstverwaltung und staatlicher Aufsicht rechtsvergleichend. Ebenfalls rechtsvergleichend analysiert sie die sich gegenwärtig abzeichnenden Entwicklungen unter dem Stichwort "Wettbewerbsgedanke im Hochschulwesen" im Verhältnis zur traditionellen "Ordinarienuniversität".

Anlässlich des 70. Geburtstags von Prof. Dr. Dr. h.c. Karl-Peter Sommermann würdigt diese Festschrift seine umfassende wissenschaftliche Arbeit. Seit Beginn seiner akademischen Laufbahn forscht der Geehrte zu grundlegenden Fragen der Rechtsvergleichung, des ausländischen öffentlichen Rechts, der Transnationalisierung sowie zu den Grundprinzipien und Werten des nationalen Verfassungs- und Verwaltungsrechts. Sein Werk ist geprägt von Außenperspektiven auf das nationale Recht, einem tiefen Verständnis der Prozesse der Internationalisierung und Europäisierung sowie der Entwicklung des nationalen öffentlichen Rechts im transnationalen Kontext. An diese Aspekte knüpft der vorliegende Band an. Angesichts erneuter Nationalisierung, hegemonialer Ansprüche, neuer Kriege in Europa und multipler Krisen – wie etwa der Klima- oder der Rechtsstaatlichkeitskrise – stellt sich die Frage, ob und wie die transnationale Perspektive auf das öffentliche Recht fortbestehen kann. Welche grundlegenden und welche neuen Konzepte prägen heute den öffentlich-rechtlichen, transnationalen Diskurs? Diesen und weiteren Fragen gehen 37 kurze Einzelbeiträge in diesem Band nach. Der Fokus liegt auf den folgenden vier Themenfeldern: Rechtsvergleichung, ausländisches öffentliches Recht, Europäisierung und Internationalisierung des Verwaltungs- und Verwaltungsprozessrechts sowie Grundwerte und Grundprinzipien des deutschen und europäischen Verfassungsrechts. Die einzelnen Beiträge sind in deutscher, englischer, französischer und spanischer Sprache verfasst und repräsentieren das mehrsprachige Werk des Geehrten. Im Zentrum stehen aktuelle Fragestellungen der Rechtsvergleichung, der Transnationalisierung sowie der Grundprinzipien des öffentlichen Rechts. Dabei werden nicht nur Antworten auf aktuelle Trends wie Nationalisierung und Populismus gesucht, sondern auch tragende Werte wie Rechtsstaatlichkeit und europäische Demokratie kritisch reflektiert. Der Band ist daher ein unentbehrlicher Begleiter für alle, die sich für Grundfragen des öffentlichen Rechts, des Europa- und Völkerrechts interessieren.
