El objetivo de este estudio es hacer tomar conciencia a los operadores jurídicos de los principales instrumentos del razonamiento y de la argumentación en el campo jurídico para comprenderlos y usarlos mejor.DAMIANO CANALE (Vicenza, 1968) es catedrático de Filosofía del Derecho en la Universidad Bocconi de Milán. Entre los años 2010 al 2016 fue jefe del Departamento de Estudios Legales "A. Sraffa". Forma parte del equipo docente del doctorado en Filosofía del Derecho de la Universidad de Génova. Ha sido profesor asociado de Filosofía del Derecho en la Universidad de Padua. Es miembro del Consejo Editorial de las revistas: Law and Philosophy, Argumentation in Context, Ars Interpretandi, Analisi e diritto, Discusiones. Ha enseñado los cursos de Filosofía del Derecho, Argumentación Jurídica, Análisis Económico del Derecho y Hermenéutica Jurídica. Forma parte del Consejo Editorial de las revistas: Analisi e diritto, Argumentation, Ars Interpretandi, Discusiones, European Journal of Pragmatism and American Philosophy, Philosophical Inquiries, Ragion pratica. TO VOLUMES 9 AND 10 OF THE TREATISE I am happy to present here the third batch of volumes for the Treatise project: This is the batch consisting of Volumes 9 and 10, namely, A History of the P- losophy of Law in the Civil Law World, 1600–1900, edited by Damiano Canale, Paolo Grossi, and Hasso Hofmann, and The Philosophers’ Philosophy of Law from the Seventeenth Century to Our Days, by Patrick Riley. Three v- umes will follow: Two are devoted to the philosophy of law in the 20th c- tury, and the third one will be the index for the entire Treatise, which will 1 therefore ultimately comprise thirteen volumes. This Volume 9 runs parallel to Volume 8, A History of the Philosophy of Law in the Common Law World, 1600–1900, by Michael Lobban, published in 2007. Volume 10, for its part, takes up where Volume 6 left off: which appeared under the title A History of the Philosophy of Law from the Ancient Greeks to the Scholastics (edited by Fred Miller Jr. in association with Carrie-Ann Biondi, likewise published in 2007), and which is mainly a history of the p- losophers’ philosophy of law (let us refer to this philosophy as A).

This collection of essays is the outcome of a workshop with Scott Shapiro on The Planning Theory of Law that took place in December 2009 at Bocconi University. It brings together a group of scholars who wrote their contributions to the workshop on a preliminary draft of Shapiro’s Legality. Then, after the workshop, they wrote their final essays on the published version of the book. The contributions clearly highlight the difference of the continental and civil law perspective from the common law background of Shapiro but at the same time the volume tries to bridge the gap between the two. The essays provide a critical reading of the planning theory of law, highlighting its merits on the one hand and objecting to some parts of it on the other hand. Each contribution discusses in detail a chapter of Shapiro’s book and together they cover the whole of Shapiro’s theory. So the book presents a balanced and insightful discussion of the arguments of Legality.
