El objetivo de este estudio es hacer tomar conciencia a los operadores jurídicos de los principales instrumentos del razonamiento y de la argumentación en el campo jurídico para comprenderlos y usarlos mejor.DAMIANO CANALE (Vicenza, 1968) es catedrático de Filosofía del Derecho en la Universidad Bocconi de Milán. Entre los años 2010 al 2016 fue jefe del Departamento de Estudios Legales "A. Sraffa". Forma parte del equipo docente del doctorado en Filosofía del Derecho de la Universidad de Génova. Ha sido profesor asociado de Filosofía del Derecho en la Universidad de Padua. Es miembro del Consejo Editorial de las revistas: Law and Philosophy, Argumentation in Context, Ars Interpretandi, Analisi e diritto, Discusiones. Ha enseñado los cursos de Filosofía del Derecho, Argumentación Jurídica, Análisis Económico del Derecho y Hermenéutica Jurídica. Forma parte del Consejo Editorial de las revistas: Analisi e diritto, Argumentation, Ars Interpretandi, Discusiones, European Journal of Pragmatism and American Philosophy, Philosophical Inquiries, Ragion pratica. The Italian Pragmatists were a group of philosophers in the early 20th century, most notably including Giovanni Vailati, Mario Calderoni, Giovanni Papini and Giuseppe Prezzolini. They gathered around the journal Leonardo, published in Florence. The Italian philosophers were in contact with the American Pragmatists, especially with C.S.V. Peirce and W. James, and developed many original and provocative ideas that made the Italian Pragmatists allies and enemies.Critics have often stressed the differences between their versions of Pragmatism. This volume emphasizes what they shared, and their value for philosophy and culture.

This collection of essays is the outcome of a workshop with Scott Shapiro on The Planning Theory of Law that took place in December 2009 at Bocconi University. It brings together a group of scholars who wrote their contributions to the workshop on a preliminary draft of Shapiro’s Legality. Then, after the workshop, they wrote their final essays on the published version of the book. The contributions clearly highlight the difference of the continental and civil law perspective from the common law background of Shapiro but at the same time the volume tries to bridge the gap between the two. The essays provide a critical reading of the planning theory of law, highlighting its merits on the one hand and objecting to some parts of it on the other hand. Each contribution discusses in detail a chapter of Shapiro’s book and together they cover the whole of Shapiro’s theory. So the book presents a balanced and insightful discussion of the arguments of Legality.
