The country reports form the basis for a comparative analysis of the various national regulations governing genetically modified organisms (GMOs) in general and genome edited plants in particular, as well as the underlying regulatory approaches.The reports, which focus on the regulatory status quo of genome edited plants in Argentina, Australia, Canada, the EU, Japan and the USA, were written by distinguished experts following a uniform structure. On this basis, the legal frameworks are compared in order to foster a rational assessment of which approaches could be drawn upon to adjust, or to completely realign, the current EU regime for GMOs. In addition, a separate chapter identifies potential best practices for the regulation of plants derived from genome editing.

These therapies need to be governed by a regulatory framework which ensures quality, safety, and efficacy of the relevant therapeutic products. On the other hand, such regulations may retard product approval and impede R&D. Accordingly, national regulations for therapies based on genome-edited iPS cells are an important and, as the case may be, decisive factor for both researchers and industry regarding their decision where to locate their R&D activities. Therefore, regulatory frameworks impact significantly on the competitiveness of states and their economies. This is why a comparative analysis of laws and regulations of different countries matters. Such a comparative legal analysis provides an important insight into regulatory concepts which, in turn, may inspire adjustments of, or amendments to, domestic legal regimes. For this purpose, experts present country reports on France, Germany, Japan, South Korea, Switzerland, and the USA. The reports on France and Germany also refer to the parameters and implications arising from pertinent EU law. Until recently, only post-mortem tissue was available for a structural examination of the brain. Consequently, the examination results could only reflect the state at the end of life. However, in order to better understand the development and function of the human brain, dynamic and functional investigations of different human brain cells are necessary. This is where brain organoids, artificially grown in vitro miniature brains, provide the opportunity for more flexible research scenarios.At the same time, however, the use of brain organoids in research and therapy raises the question of how these new entities are to be treated from an ethical and legal point of view. Against this background, this volume aims at clarifying the normative implications of the use of brain organoids in research and therapy. The ethical reflections on the status of brain organoids, informed consent, human-to-animal chimeras and neuro-enhancement are mirrored by corresponding legal analyses. The ethical and legal assessments are preceded by an introduction to the scientific and medical background of the brain organoid technology. A final chapter will be devoted to the issue of whether international harmonization of normative standards for brain organoid research and therapy is feasible and advisable.

What exactly is an embryo? In German law, the embryo is defined according to the criterion of developmental biological totipotency. But when somatic cells are reprogrammed into induced pluripotent stem cells, it can at present not be completely ruled out that these cells undergo a temporary totipotent stage. The contributions to this volume examine what consequences arise out of this hypothetical assumption for the biological significance and the moral and legal assessment of human embryos.Setting out from the presentation of the historical concept and current interpretations of the term developmental biological totipotency, the legal section of the volume examines to what extent totipotency is an adequate criterium for the legal definition of the embryo, or whether it needs to be amended. Finally, the philosophical section reflects on the definition of the embryo in terms of potentiality, naturalness and purpose.

Vorrangig ist zu klären, inwieweit künstlich erzeugte Entitäten unseren normativen Auffassungen von menschlichen Embryonen entsprechen und welche Kriterien für die Beurteilung heranzuziehen sind. Eine wichtige Bedeutung kommt den Kriterien der Natürlichkeit und Artifizialität sowie der Potentialität und der entwicklungsbiologischen Totipotenz zu.The numerous methods for an artificial generation of human embryos which have been developed over the past decades raise the question of the ethical and legal evaluation of these entities. It is of fundamental importance to clarify to what extent artificially generated entities correspond to our normative conceptions of human embryos and which criteria are to be used for the assessment. The criteria of naturalness and artificiality as well as potentiality and developmental totipotency turn out to be essential for the evaluation.

Private Interessenorganisationen sind auf staatliche Veranlassung hin bisweilen so eng mit den Staatsfunktionen der Gesetzgebung, Vollziehung und Rechtsprechung verflochten, daß die privat organisierten Interessen bzw. deren Vertreter die Ausübung dieser staatlichen Funktionen (mit-)steuern. Hans-Georg Dederer untersucht u.a. das zentrale Problem, das sich dabei stellt: die demokratische Legitimation dieser "korporativen Staatsgewalt". Als das normativ effektivste Legitimations- und Steuerungsinstrument vermag das Parlamentsgesetz neben funktioneller, organisatorischer, prozeduraler und inhaltlicher Legitimation insbesondere auch personelle Legitimation zu vermitteln. Um ein hinreichendes Legitimationsniveau zu erreichen, bedürfen konkrete Formen korporativer Staatsgewalt regelmäßig parlamentsgesetzlicher Steuerung dessen, was im Lichte des Demokratie- und des Rechtsstaatsprinzips in Bezug auf die jeweilige konkrete Form korporativer Staatsgewalt 'wesentlich' ist. Wesentlich sind beispielsweise die Sicherung hinreichender Interessenpluralität, die tendenziell vollständige Auswahl der zu repräsentierenden Interessen und der für diese Interessen repräsentativen privaten Interessenorganisationen oder die Merkmale für Eignung und Befähigung der Interessenvertreter.
